I sent my email to them Saturday and just got my e-mail response today saying I'm approved:

My Feedback
We were told a couple weeks ago that a tactical team deployment somewhere out east had an officer fire one round accurately, then a second follow-on shot went 8" off target, even though the officer insisted he was on target. Subsequent investigation revealed a reticle drift after the first shot. In light of this and the recent lawsuits by the DoD, our agency and the others within our county have put out new policy that tactical teams are restrained from using EOTech weapon sights, and all rifles that are personally owned for duty use are restricted from having an EOTech on them.
ETA: I've had an EOTech for personal use since 2010 and have yet to have an issue with it. Just means I have to shell out more $$ to put an optic on my duty rifle.![]()

I sent my info in last night.
I noticed on their website FAQ section that it now says that if you sight in at a warm temp and then shoot in a colder temp, you need to re-zero your sight and that the thermal shift gets worse the more the temp gradient from the temp of the original zero. I just can't imagine a scenario where that would be acceptable to anyone. Even a twice a year plinker.
I think I'm going to try the Aimpoint T-2.

Makes me feel better about my decision to go with an Aimpoint Pro.
...but I hate to see it when something goes sideways like this.
