(As an aside, I thought it was weird that the officer informed Moore that he could not enter his home until the warrant was produced and executed... I think I understand the intent, but can a LEO on the board explain that one to me? How can an individual be kept from their residence without any paperwork or obvious things like being arrested?)

DECEMBER 17--An “agitated” Internal Revenue Service employee was wearing a tin foil hat last week when Massachusetts cops confronted him for illegally possessing severalfirearms, according to a police report.
Acting on information provided by a Department of Homeland Security investigator, Tewksbury cops Tuesday afternoon pulled over a car driven by Roland Moore, a 46-year-old IRS customer service worker.
The federal agent had told police that he was investigating Moore, who had recently been “evaluated for possible mental health issues.” During conversations with IRS inspectors, Moore reportedly admitted to having guns in his Tewksbury home. A records check, however, showed that Moore’s firearms license had been suspended nearly six years earlier following an assault arrest.
As detailed in a Tewksbury Police Department report, when cops contacted Moore, he was “wearing a piece of tinfoil on his head under his cap” and he was “agitated” by the presence of law enforcement officers.
Moore, who admitted having four firearms in his home, denied a police request to enter the residence and retrieve the weapons. “Moore laughed and stated that it was his natural right to have guns to protect him home,” noted Detective Andrew Richardson.
As first reported by The Lowell Sun, police subsequently secured a search warrant for Moore’s home and seized the four guns, two of which were loaded. They also removed a “large amount of ammunition and supplies to manufacture ammunition” from the property.
Moore was charged with four weapons possession counts, as well as failure to surrender firearms as ordered following his assault bust. Moore, who has pleaded not guilty to the charges, is free on his own recognizance.
A District Court judge has barred Moore from possessing dangerous weapons and ammo and has directed him to comply with any current mental health treatment. Moore is next due in court on January 26. (3 pages)

This should be a major concern to gun owners everywhere.

As first reported by The Lowell Sun, police subsequently secured a search warrant for Moore’s home and seized the four guns, two of which were loaded. They also removed a “large amount of ammunition and supplies to manufacture ammunition” from the property.

The mind set of those out to destroy the 2nd without a Constitutional Convention, will stoop to any means. Sensationalism, scare tactics, blatant lies and fabrication of Facts to put any gun and owners of them in a negative light.

Who's wearing the tin foil now Kazoo? They are just trying to pass common sense laws to help us all out. I mean, who needs more than 10 bullets to kill a deer. Barney Fife only got one and he had to keep it in his pocket. Number of mass shootings in Mayberry = Zero. See it works.

I wish I had his stash of 22. I used to live a town over from Tewksbury, Mass is very anti-gun from what I remember. I called to ask about getting a permit to carry and the cop grilled me where I lived, why did I think I should be able to carry, etc. When the lecture started I thanked him for his time and hung up.

I am at a location that I have probable cause to believe contains evidence of a crime. I have applied for but not yet received a valid search warrant for that location. The resident or owner of the location arrives and wants to enter the location:

    A. I ask for consent to search the location
    1. Yes, consent is given and I begin my search.
    2. No, consent is denied...go to B.
    B. Allow the person to enter and then use their entry as the basis for entering and conduct a warrant less search. Exigent circumstances being that the evidence I believe is present inside may be altered or destroyed.
    C. Deny the person entry and constructively seize the location and secure it until the warrant is issued before beginning my search. As long as the time I have secured the location is reasonable and I can articulate that to a judge, the seizure will likely be considered lawful.
    D. Allow the person to enter and go out for coffee and donuts. There are plenty of other criminals I can catch later.
    E. None of the above.

My bad what the hell was i thinking. Clearly not using Common Sense caused this ruckus in the first place.

On aside note His Highness is in HI for some R&R. He'll be signing another EO sunday, "maybe" monday night. Tightening the definition of who or what a gun dealer is and limits of what one can sell, before requiring a FFL. So 1 gun will now classify you as a dealer. Wonder when the ATF will be issuing FFL's to every gun owner?
