The city has the power to fine homeowners for not shoveling, BUT there has never been a civil suit in Colorado holding the homeowner liable for an injury on the public sidewalk in front of a home. The attorneys at the big insurance company I worked for gave a big presentation about it and basically said, "You can get a fine for not shoveling, but chances are very slim you'd be held liable for an injury on the public portion, assuming all you did was not shovel." Meaning, if you clean your fish tank onto the sidewalk the night before, or point your downspouts to drain onto the sidewalk, etc, then you could be held liable for an injury. They said that local legislation puts the shoveling of public walks onto the city, but the city turns around and tells the property owners to do it.
