The police investigating a crime may legally detain those persons they believe may be witnesses. The four factors used to determine the legality of the detention of witnesses are:
1) the seriousness of the crime witnessed,
(2) the nature of the information the witness can reasonably expect to provide,
(3) the level of proof that the witness can provide,
(4) whether there are less intrusive methods to obtain the same information.
Safety at the scene is always paramount so don't expect to be interviewed right away if they police are still looking for the shooter(s).
