    Default Cabela's Sold Me a New Gun from 1968

    I was at Cabela's Lone Tree yesterday and found a couple of interesting guns. They were both Polish P-64's in 9 x 18 Makarov. I have had one for years so thought if the price was right I might get another. I looked at one from the used gun section and one from the new gun section. What I found interesting was that one was claimed to be "new" since they were all made during the cold war in Poland and production discontinued in the mid 80's. These never left Poland until the cold war ended and production had stopped. So I ask the gun guy how these could be new? He said they came from Century Arms International and they are new. Every one of these that I have seen is stamped CAI so nothing new there. I proceeded to tell him the P-64 production started in the early 60's and continued into the 80's when it was replaced by the P-83. All the while comparing each gun to the other, the slide on the "used" gun was stamped 1976 and the "new" gun was stamped 1968, which I pointed out. I also pointed out the holster wear on each gun. The counter guy listened and said he would talk to the gun buyer to find out how this 1968 gun was considered new, and I left.

    Today I returned and could not locate the guy I had dealt with so I had a different guy show me the new gun and asked if he knew why these were considered new, no idea. The used gun was no where to be found and that was fine with me because it was $289.99 with one mag and "new one" was $224.99 with two mags. One of the reasons I was trying to get the gun as "used" was because of the sale, 10% off on all used guns in stock. They never budged on the price or there position that they are new.

    At the gun check out section one guy kept saying they got them from CAI refurbished and therefore they are consider new. What really got my goat was even though the Polish P64 is clearly listed on the C&R list he said it could not be sold to me as a C&R because it was refurbished. I told him to his face, as I was going through the two f***ing hour BGC, that I would be selling it as a C&R, no response. I asked if he had any paper work to back his claim that these are now considered new, nope he didn't.

    So my question, is it even remotely possible when a used C&R gun is refurbished it is now considered new and can't be sold as a C&R? Nothing internally or externally has been changed on the gun all the same original parts, caliber and configuration. Can they get in any kind trouble with the Feds claiming a clearly used gun is new and selling it as such? In my years with my FFL and now with a C&R I have never heard such a claim.

    Sounds shady to me, but whattya expect from a big-box store?

    FWIW - I bought a new S&W 586-8 from Blucore for a used gun price. New in the box, unfired. The buyer ordered it, but ordered the wrong model. Transaction had been made, even though he handed it right back as a trade-in. Boom - used gun. They told me they couldn't legally sell it again as new. Got a helluva deal on it!

    I'm sure it's at least as brand new as those ones on Armslist. You know the ones. "Brand new. Only fired three magazines through it."

    Yes, Once altered from it's original config it's no longer C&R. Refinishing supposedly counts, as it's not in original condition. Just as a sporterized mauser is no longer C&R.

    BUT... i would go back show him the C&R regs and see what they say. Probably gonna hit a brick wall, based on their lackadaisical attitude.

    However if you're that torqued over it. Apply for a C&R, avoid the bs and 2 hr wait time.
    I have a C&R and they would not accept it, even though I have used it at that Cabela's. This price was cheaper than any body else is selling them right now C&R or not. If they refinished it somebody wore it around the store in a holster to get the holster wear on the slide.

    IDK about refinishing, you can repair a gun and still be C&R as long as you don't alter the design. And there are a ton of "arsenal rebuilt/refinished" C&R guns from importers/distributors. More likely a case of the stupids being enforced by a boot licker.

    It could also be how CAI sold the gun to them. Unfortunately some stores don't care, or know what they hell they're doing.

    Rondog, that's what I was thinking once the gun has been sold, even if never fired, it's used. Maybe if it was only used by a foreign government it doesn't count, LOL
