    Default Navigating the state BGC law.

    Have a co-worker that is in Florida for the next few weeks and he would like me to ship his rifle to him so he can sell it down there. He has the ability to give me access to his firearm here in Colorado while he is in Florida. The way I understand the new background check law is that I can not take possession of the firearm to transport it from his house to the shipping service unless I pass a background check to pick up the firearm.

    According to the law am I missing anything here? Technically is there any legal way to ship his firearm to him?

    Another problem scenario from the law that doesn't infringe on our rights. I want to see the advice from our resident experts.

    Too bad you don't have a "kitchen table" FFL buddy you can take with you to your friend's house and pick up the gun. Then it would be in the FFL's possession.

    I wonder if he'll need a FFL on his end too?

    Exemptions to the BGC law:

    for up to 72 hours, during which time the transferor may be jointly and severally liable for damages caused by the transferee's unlawful use of the firearm; or

    I would think a special POA naming you as his attorney-in-fact would suffice. After all, you're not really "taking possession" of the gun yourself, you are simply acting as an agent for your friend. As for what happens on his end in FL, do inter-state transfers require an FFL? I think the ATF website explains what needs to be done in the case of an inter-state transfer of a firearm.

    What the OP does outside of the forum is between him and the law, but condoning illegal activity on the forum is prohibited....
