If your enemy had a rule that was so misunderstood, the majority of the populace thought it meant they could be trampled on as individuals, and applied to people who do not even fall under its purview (i.e., non-citizens and people not here), wouldn't you make use of that? It's a great rhetorical device. The Constitution is, pun intended, a trump card for anyone to shut down the mentally deficient who 1) have never read it 2) couldn't argue themselves out of a wet paper sack 3) are given over entirely to emotion and logical fallacies.
It's like saying "Ah, you're a Christian, turn the other cheek!" while they're raping your wife. No, you freaking kill the SOB because you have a duty as husband and a man to stop evil in its tracks.
