The Harvey situation would also likely been a non-issue had the teacher backed the students claims. However it sounds like she had second thoughts that her previous decision might be questioned, so she pulled the Hillary pass and left Harvey to swing in the breeze.

Sometimes though, the individual is still protected under the entity's broad insurance umbrella, or obligations of the state to defend them, or under risk management indemnification funds (state funded). You can't obligate the state treasury in an action in any circumstance. County may be a different story, but at most they can raise bonds or something else to pay obligations, or it is usually covered by an insurance umbrella that will then hike premiums.

Where additional pressure comes from is either the city/county attorney or the state A.G. has a lot of pain in defending actions like this... especially if there is more than one.

    That's good to know.

I would prefer there be a hearing to determine that and then the offender is on his own dime. And I'm only talking about the most serious conduct here. Not "he made me feel bad" and therefore I sue him personally. Nor am I talking standard liability that is a "cost of doing business" in the public sector.

The next time a candidate says they will enforce the laws already on the books, think again about the laws and their effects.
