Its really not a "military" drone per se. Its a hydrographic sensor platform. The USNS Bowditch, which was operating it, is civilian crewed.

Since it's unmanned it would be easy enough for them to claim it was in peril and claim rights of salvage on it, though they still do have to return it they can try to claim a reward
