The Dindu that robbed me almost 20 years ago drew his little .25 from his pocket and with much flourish and exaggerated movement racked the slide before pointing it at us (which would get him shot by me today instead of just standing there in condition white like I did in my youth).

I think a real gun that isn't loaded carries the same penalties as a toy gun. Which I believe is the same as a real gun, loaded or not.
