    Default Use of deadly force in OK.

    WOW is all I can say about this one. Given the article, I think he did the right thing but that's and incredibly difficult situation.

    Officials say Leland Foster was allegedly threatening the mother of the children with a knife during the incident. A 12-year-old girl who was inside the home ran to a neighbor's house for help.


    The neighbor, Cash Freeman, rushed back over to the home to find Foster trying to drown the 3-month-old twins, a boy and a girl, in the bathtub.


    Freeman shot Foster twice in the back with a gun.

    Damn. That's a tough one. He did the right thing. I hope the DA sees it that way. Being OK, I'm fairly confident the legal system will be sympathetic with the man.

    It annoys me that we still hold to this foolish myth that shooting someone in the back is always questionable.

    This is a clear cut case of defense of the lives of two children. There's no reason this guy should be even remotely worried about being charged and in fact next time they have one of those banquets where the local PD awards citizens for acts of bravery and heroism, Freeman should be the guest of honor (and knowing Ada, Oklahoma I bet he will be ... many many years ago my uncle was the Anchor for the NBC affiliate in Ada)

    Absolutely. The media would have screamed WHY DIDN'T YOU SAVE THOSE KIDS?? If he didn't act.

    Well there's a lot more to consider than just the fact the shooter shot someone in the back. As a matter of fact, I'd put that near the bottom of the list of factors to consider. I agree with you mostly...if the shooting is justifiable it doesn't matter where you shoot the bad guy. Although it may be an issue one side tries to raise in any legal proceedings. I made my comment based on the fact that I don't know what OK law says about the use of deadly force in a self defense situation. Frankly, all I know about this shooting is what I read in the one article...and we all know how accurate the media is. Not to mention we live in a political climate where being black almost automatically gives someone extra "points" in the sympathy column.

    I've faced more than one investigation for using force against someone (as a LEO) and I can tell you I ALWAYS worried about the outcome, regardless of how justifiable the use of force was. I've also sat in federal court for a week as the respondent in a $15M civil lawsuit over something I didn't do. Yeah...I was worried. It's easy to say "don't worry about it" when you're sitting in front of your computer with a cup of coffee. When you're the one holding the gun when the cops show up, not so much.
