The Idaho legislature is well on the way to passing a very strong "stand your ground" law. It codifies long-standing legal precedent in the state.
The new law assumes people act reasonably when defending their homes and assumes anyone unlawfully entering does so with the intent to commit a felony. It also extends the protections to businesses and vehicles. The new law defines a dwelling to include temp structures such as tents as well and puts the burden on the prosecution to prove a person defending home or property under the law acted unreasonably.
The state sheriff's association fully supports the law. I'm looking forward to seeing it pass.
