    Firearm background check law requirement upon transfer? Besides FFL's, who else can run background checks?

    Good question. IANAL, but here's how the law currently reads:

    "Unless a specified exception applies, before any person who is not a licensed gun dealer transfers or attempts to transfer possession of a firearm, he or she shall:

    Require that a background check be conducted of the prospective transferee; and Obtain approval of the transfer from the Colorado bureau of investigation (bureau) after a background check has been requested by a licensed gun dealer."

    I remember when the law changed that it made an additional headache for getting guns back from the police because now people had to pass a background check again. The police aren't going to simply stop taking people's guns from crime scenes or DUIs just because of that law change though.

    There was an incident that made the news a few years back. Lady got into an accident...EMT found the lady had a ccw and turned the pistol over to an officer. After the lady got out of the hospital the police stated they didn?t have the ability to run the background check to return the firearm. She had to get a lawyer and threaten legal action. The police then agreed to meet her at an ffl to get the background check done.

    Technically the police were in violation of the law as they hadn?t had a background check done to take possession to begin with.
