    So, for a private transfer, does the FFL keep the firearm being transferred and do both parties come back?
    Or, does just the buyer come back?

    Probably just depends on how the FFL handles it. There are no real rules in place.

    When I?ve done them in the past the FFL usually takes possession of the firearm from me and enters it into their book. After that, I?m pretty much done as the seller because technically the FFL sort of owns it since they took possession of it from me. Once the buyer passes his background check they will release it to them.

    I?ve done deals where the seller and I couldn?t meet up for the deal. I?ve dropped off my firearm with the FFL and went home. A day or two later the buyer goes into the FFL and does the background check and picks it up.

    It's up to the FFL. Some FFL's don't want the liability of holding onto something that is someone else's property, and I get that. I do know that Ark Tactical will hold onto the firearm so only the buyer needs to come back. Once the BGC is initiated, the seller pays the buyer, firearm is turned over to Ark and the seller walks away.

    I suppose if the BGC came back with a denial the seller would get a call from Ark telling him to come pick up his firearm and paying back the buyer would be between the seller and the buyer. I've never had an incident where a BGC was denied so I don't know.

    Damage Factory does not hold the firearm so both the buyer and seller have to come back which IMO is a hassle.

    Its really up to the FFL if the firearm is kept by the dealer. IF it is kept by the dealer and the buyer's BGC came back as denied, the FFL has to conduct a BGC on the original owner in order to transfer it back to him. If the owner keeps the firearm and comes back after the buyer's BGC came back G2G, then the FFL takes possession of firearms and transfers to new owner.

    Yep.. thats how it works. If the buyer gets denied, not my problem. I got my money and the gun is technically property of the FFL. It would be up to the buyer to clear up whatever caused the denial. If they can't, then the FFL & buyer can workout a deal to sell the firearm or whatever. But as soon as I accept payment, deal is done, no refunds.
