The gun is his after payment, but can't take it home from the FFL until his permission slip is approved. If he fails on appeal and abondons it at the FFL, how is the seller stealing? The seller is under no obligation to make sure the buyer passes his background check. That is a consequence of silly unnecessary universal background checks.
The buyer can ask the FFL to sell the gun for a fee or store it for a fee. The sellers obligation ends with cash in hand and transferring it to the ffl for the background check.
This isn't like dealing with Craigslist and a rare occurrence, sorry you have such a selfish outlook. At worst besides the bgc fee etc, id maybe ask for a $20 for time and fuel.
