Awkward situation

I had a buyer (NOT a forum member) fail the background check on a purchase. I don?t have the details but the ffl called me to say the buyer, someone he knew, failed. The deal was to be completed upon passing obviously. The buyer gave me a sizable deposit which I returned.

Seemed legit, he said he was going to appeal. Just an awkward meeting to say the least. Have any of you run into something similar?

They fail, not your problem. The FFL has a free gun in his inventory.

That is one of the reasons why I have been selling on consignment, it lets the shop deal with hiccups like this.

Seems to me that if he gave you a deposit rather than payment in full, he probably knew there was a chance he would be denied

Right, it was awkward because the guy was very apologetic-he’s a professional (doesn’t mean something isn’t off in his history)-kept apologizing, said he didn’t understand why he got denied. Yes I know it happens mistakenly as well as legitimately. We had a great chat leading up to the purchase, it’s a fairly expensive 1911 and he definitely knows his firearms.

I agreed to take the deposit because I got a good feeling from him. It’s the first gun he was buying post divorce so maybe there’s something there that needs to cleared.

I like to believe I’m good at reading people, has served me well in my various careers and never got the feeling something was off.

so, did you get the firearm back? Or are you going to leave it with the FFL to see if this guy's appeal is successful?

CBI appeals are taking at least 90 days now

I had a similar situation, but it was before the 4-6 day CBI mess we have today. We waited at the FFL's home, when he failed, he paid the FFL for the background check and we parted ways. He did end up getting it fixed, something to do w/a prior DUI that the paperwork had gotten messed up (or something like that). Sold the pistol to the next buyer.

I also had a buyer recently (last 6 months) who was here w/a green card - her check took a bit longer, but the FFL (awesome guy BTW), held the gun and the cash for us, transferred the gun to her when she passed, and held my cash for me until I could get back. Can't say enough good things about that FFL!

I'm wondering these days of the liberal anti-gun political "elite" here in Colorado aren't somehow influencing this "slow-down". Maybe it's "tin-hat paranoia", but with all the BS going on from the WH with the imposter "Slowjob" Biden, I wouldn't put it past the sheep here to follow that lead. I just find it hard to believe people are still buying at the accelerated rate they were several months ago, but I could be wrong.
