Default Colorado U.S. District Court issues TRO against Superior's magazine and gun ban

Not sure if I missed this, or you guys didn't notice the win?

    https://reason.com/volokh/2022/07/22/colorado-u-s-district-court-issues-tro-against-magazine-and-gun-ban/

Judge Moore wrote: "the Court is unaware of historical precedent that would permit a governmental entity to entirely ban a type of weapon that is commonly used by law-abiding citizens for lawful purposes, whether in an individual's home or in public."

The Superior case is the first one to result in a judicial opinion, and could be persuasive, albeit not binding, precedent in cases nationwide.
'Unless a law-abiding individual has a firearm for his or her own defense, the police typically arrive after it is too late. With rigor mortis setting in, they mark and bag the evidence, interview bystanders, and draw a chalk outline on the ground' - Judge Benitez , 2019, Duncan v. Becerra.

'One of the ordinary modes by which Tyrants accomplish their purpose without resistance is by disarming the people and making it an offense to keep arms.' Supreme Court Justice Joseph Story, 1840.

Let the screaming at the sky begin!

Can we arrest and charge all of these local government officials who approved this crap with conspiracy to violate the constitutional rights of citizens of the United States?

"...courts are supposed to decide Second Amendment cases on text, history, and tradition. Judge may not decide based on their own opinions about good policy, nor should they defer to legislative policy judgements."

    Amen.

However, it is a small skirmish in a much larger battle.

As Mr. Wolf said, "Let's not start sucking each other's dicks quite yet."

The left has had their hands slapped going after specific gun types and the magazines they require.

    What does that leave?

    Ammo.

Watch for bans on certain types, including "cop killer" hollow points and "weapons of war" full metal jacket. EPA could declare any exposed lead a hazard.
Background checks, licensing, obscene fees and taxes plus laws on storage and possession. Not only of assembled ammo but also on their four components, especially primers.

Some of you may have read my predictions on using credit services and insurance providers to curtail the production, shipping and storage of ammunition and its components.

Was extra surprised that the judge was an obama appointee.

The bigger question is, what is the impact on the state's mag ban based upon the Judge's order?

The Superior, Boulder and other cities magazine bans move the count down to 10 rounds from 15 as well as there is no grandfathering of existing magazines so I?m guessing it does nothing to the state ban at this point.

While specific to Superior, it is telling on the life span of the current CO ban.
