    Default Contingency fees for personal injury attorney

    I am looking at a lawyer to work my vehicle accident from last year.

    Is this fee structure reasonable?

    The percentage of attorneys' fees based upon the gross amount collected as listed here in will be as follows:

    - 33 1/3% if the claim settles before sui is filed, or arbitration is demanded.

    - 40% after the date of filing of any suit, or arbitration demanded.

    - 50% after the filing of a notice of appeal or if a re-trial is ordered.

    Yes. Virtually any personal injury attorney is going to use that fee structure.

    These cases rarely go to court if it can be established beyond a reasonable doubt that the other party was at fault... their insurer just drags things out before agreeing to a settlement well above the pittance originally offered. Sometimes they wait 2 years to establish MMI.

    I've seen some a bit lower, 30/40, but if they are not requiring a retainer, that is usually the racket. Why it pays to be an attorney. One big case sets them up for life.

    What is more important, is their track record. Also if they are willing to go to court if the opposing party won't settle. 99% of cases settle though.

    The last time I sued for personal injury was 46 years ago and it was 33%if settlement was out of court and 40% if it went to court.

    As I learned after my wreck a few years back, that's pretty standard. As has been stated.

    If you need a recommendation, the lawyer in Denver that handled my wreck in 2020 is pretty good. I can send his info if you like.
