    The Colorado Legislative Assembly is discussing a bill that has negative implications for manufacturing companies. Currently manufacturing and industrial companies in Colorado are exempt from paying sales tax on electricity and gas costs. House Bill HB-1190 would eliminate that tax exemption and charge these companies sales tax on both electricity and gas purchases. U.S. based manufacturing companies have been struggling for years to remain competitive in a global marketplace. HB-1190 would effectively create a new tax on Colorado companies and manufacturing sites and thereby make them less competitive. So while it has the potential to increase $48 million in new revenue for the State, HB-1190 is a short-sighted approach that will have the long-term effect of reducing manufacturing jobs in Colorado.
    It should be noted that this is one of many bills currently under review that would increase operating costs for businesses. XXXXX has budgeted $12.1 million for electricity and fuel costs in 2010.
    The 2.9% sales tax (state portion) on this amount comes to almost $350,000 per year. This increased sales tax expenditure will reduce the competitive advantage that XXXXX currently
    has compared to Asian foundries. It is also possible that the City, County and PPRTA would follow the state which would increase the tax to 7.4% and $850,000 per year.
    We are competing with companies that manufacture products overseas, and right now - we are competitive.
    Force my company to pay $350,000 (up to a possible $850,000) dollars in additional taxes and well - I just might be OUT of a job very soon.
    They'll shut this plant down in a heartbeat if costs go up that much.

    And they are going to have to appropriate $94,000 to collect these taxes...
    The bill requires but does not contain an appropriation clause. Staff has prepared amendment J.001 (attached)
    to add a provision appropriating $94,322 General Fund and 0.9 FTE to the Department of Revenue for FY 2009-10 for implementation of this bill.

    Looks like EVERYONE voted for it - I was told:


    Representative Gardner's input is that the only Colorado Springs Representatives in favor of this bill were Dennis Apuan (District 17, which is SE Colorado Springs and Ft Carson)
    and Michael Merrifield (District 18, which is downtown Colorado Springs, Old Colorado City and Manitou). All of the other Representatives were opposed to the HB-1190
