Back in the early 80's all police officers that were in gun fights were charged. If you killed someone you were charged with murder. They did not just choose to press charges or not. The case was presented to the grand jury and they decided. If they were on your side they returned a no true bill. Or you went to trial. If you got a no true bill, or were found not guilty, then it could never be brought up again. At least not criminally. So it was done.

That meant that it could not be held against you in any future promotional exams, or internal investigations. And the DA looked good for not ignoring it or just giving you a pass.

So, if they charge him and he is found not guilty, in a sense, its better for him then them deciding not to press charges at all. And the local government won't get torched for not charging him. Or just sweeping it under the rug so to speak.
Unless a jury of brainwashed Commiefornians find him guilty then there is a shitstorm for all involved.
