    When San Luis Obispo County Sheriff’s Deputy Darren Murphy responded
    to a “shots fired” call in April 2008, he decided en route that he was
    going to make an arrest.
    He did far more than that. Murphy and other deputies made an
    unwarranted entry into a home, and then into a locked gun safe. Murphy's
    uncensored, darkly disturbing observations and behavior following his Code-3 arrival
    at the rural home of longtime SLO County resident Matt Hart were picked up
    by Murphy's and other deputies’ own recorders. Those recordings provide a
    rare, frighteningly revealing, behind-the-scenes perspective of how one
    local law enforcement agency views the Fourth Amendment to the U.S.
    Constitution, and other laws its personnel are sworn to uphold.
    Sheriff’s spinner Rob Bryn declined to confirm the identities of any
    of the deputies appearing or heard in the recordings, or to discuss any
    aspect of the Hart home invasion. So we've done that for you. (Bryn, ever the
    public servant, eventually stopped responding to e-mails from a KCCN.tv
    reporter.)
    Deputies’ deportment in the field as exhibited by their own words, as
    well as their plainly audible efforts to fabricate justifications for
    their actions, are lamentable. Local county prosecutors’ subsequent abuse of
    power, wielded in a cavalier, clumsy, and transparent effort to avoid a
    lawsuit, also is troubling.
    But in the larger scheme of things, it is the systematic dismantling
    of the Fourth Amendment by over-zealous cops and an enabling judiciary that
    should be a cause of concern for every American citizen. Incredibly,
    Hart's case may be less of an anomaly than it appears.
    The question is: Should law enforcement officers like Deputy Darren
    Murphy be allowed to make day-to-day, life-changing decisions regarding the
    fate of law-abiding citizens?

    I Am still of the firm belief that when a Law enforcement officer breeches the rule of law and there is evidence of such, that they should be prosecuted. If a department is accused of a breech of law it should be investigated by a HIGHER office and if evidence is found, Prosecuted by a HIGHER office to prevent bias.
    No one is above the law.

    I think the brandishing laws need to be amended to prevent abuse by some Law enforcement agencies.

    If I am on my property and there is no clear evidence of a crime, LEO stays over there until you get permission or get a warrant AND Present Such Warrant. Gun, No Gun, regardless Possession of a firearm ON your property in itself isn't a crime. Unless you have Probable Cause, or a WARRANT, the LEOs are committing criminal trespass and should be charged as such.

    Had there been a Body.. or other Victim evidence totally different story.
    As far as I saw from the police cruiser cams and other photos, no law was being broken. Anyone else Notice large hill behind tree that was holding the .22 target, negligent discharge my ass.

    They're probably just mad that they had their doughnut break interrupted

    Enough Bashing on these knuckleheads, it is an older story and it's sad that these guys have tarnished the reputation of the Law Enforcement profession.
    To the Good cops out there, keep doing what yer doing.

    To the ass-hats... If you are going to do something stupid and Trample the U.S. Constitution and Citizen rights, keep on Rollin the cameras and Microphones ya dumb shits.

    Warrantless search, illegal search and seizure. only part that sucks is that he is goign to have to pay a good amount to get his legal property back. last time I checked it is legal to discharge a firearm in unincorporated areas.

    What i dont understand is where they found this "machinegun" they charged him with?

    Cops say one thing, Almost All Witnesses say the opposite and somehow the video isn't working right and we had to send the tape out and it got lost...

    ohh, and one of the cops involved... was in another "Suspicious" shooting in 2006.

    of course it smells funny. within 24 hours we're able to see a video of a whale breaching onto a yacht, yet the store security cameras have "technical issues" and won't be released until september.

    I watched all the videos, and I would share my opinions if I thought it wouldn't make me a target for the authorities.

    Clear violation of the law and the fact that the officers haven't been placed into custody is a crime in itself. DA should be charged as well.
