    typically the contract will outline the earnest money as liquidated damages. if they back out the seller keeps the earnest money. usually it will be split with the listing broker as they have aslo put it a lot of time and effort to get the home to closing.

    Sorry to hear about the sale. My wife is from Galveston. I was born and raised in Oregon but the Family is from here so go figure.

    No some need to take this next statement with a grain of salt. I would rather have Texans move here than Californians. Now anyone that posts on this board that has moved from CA cant be all bad because they have a clue.

    Back in the early 70's our governor in Oregon warned us what was coming and what would happen. It did so now I find myself here after seeing what had happened back home.

    Just some thoughts.

    Howdy Brotha! What part of the Lone Star state are you from? I grew up it Ft. Worth. Spent ten years in Ohio and figured I'd been through enough Hell, so moved to CO.

    The only thing I miss about TX is BBQ and TexMex food. Don't miss the heat or the people. I don't miss anything about OH.


    Too bad about the sale falling through. Were they military or other transfer? I can't see military folk eating 3K without hurting.

    I agree, we don't split earnest money, but most of the deals I have seen go bad that was the way it was done. We are buyer's brokers for the most part so we wouldn't get to see any of it anyway.

    Dad retired out of Ft. Hood so we were in central Texas. Killeen, Copperas Cove, Waco, Temple, etc. I miss some friends and the horses. That's about it. The heat and food I could live with or without, never really bothered me.

    Well a week after this mess I have another contract on the house. Another inspection Sat. The new buyers can use the pre paid appraisal the last losers paid for. My realtor took only $1000 deposit this time. I was a little upset with her. She is working both sides of the deal now.

    $1000-$10000 deposit won't make any difference if someone changed her mind (yep HERs). You got a deal going, be glad! I hope being upset with your realtor does not impede the sale. Good luck.

    Inform her that if the deal doesn't go through you will be changing agents as she has obviously developed a Conflict of interest.
