Insurance company tomorrow but they're aware of it. Probably 100ft from their office when it happened! At least I only have a $200 dedutable although I'm not sure what the ticket will cost

I do need to get her details though as I was more concerned about my son as he was pretty upset. Although if she claims a different story where do I stand?

It's just your story vs. her story. Usually, your insurance company will stand behind you in cases where both stories are possible/likely, but there are no hard facts to dispute either one.

Only if your story sounds really fishy, will they not fully support you. In my ex-professional opinion, your story doesn't sound hokey, but be prepared to have your company tell you that you failed to make sure the intersection was clear before you proceeded to turn. They'll probably tell you that if you were cutting it so close that just slowing down got you into an accident, that you shouldn't have been turning.

Also, I think that the company that I worked for trained us pretty well as far as being ethical, but not all adjusters are claimed that way. Some companies train their adjusters to ALWAYS find a way to put some sort of comparative negligence on the other driver. I've heard stories of adjusters assigning people 5% fault in an accident where they were stopped at a red light and rear-ended; giving the reason that if you weren't stopped there, no body could have hit you. It's total bullshit, but is a reality. Fortunately, I never came across any cases first hand where that happened, so I wouldn't worry about it too much.

Ed, request a copy of the accident report from the police department. The back side of it will have the officers understanding of the events that occured either in writing or in writing and a diagram. See if the girl is listed on the report, either as a witness or as an involved party.

I'm guessing you were written a citation for failing to yield turning left. Not sure based upon what you've posted that will minimize you from that. I would be interested to know what she told the officer what her involvement was in the events, if any.

Glad you and your son are okay.

Yup failing to yield making a left = citation. No way out of that one even if it was caused by another driver

    As for the car:

don't ever let someone leave the scene of an accident without getting their info and writing down their plate number.

Better yet not only get that info, but..... when you replace your batteries in your smoker detectors everytime we have a Daylight Savings Time adjustment (you DO do that, don't you?), swap out a new disposable camera in your glove box and get pics of all cars and drivers/passengers involved - including the damage to all vehicles), and anything else in the vicinity that might be relevant.
