While I think this is a sick book and the person who wrote it is likely deranged and if he doesn't have a record yet he probably just hasn't been caught yet. That being said I think that being charged with 'lude acts' is ludicrous. As far as I'm concerned this is a blatant violation of his 1st amendment rights. Just because someone doesn't agree with the contents of a book doesn't make it fair for them to prosecute the guy.

Does anyone else see it this way? When I first heard about this I thought maybe I was the insane one here since all those who were 'unbiased' that were reporting were calling him some pretty deplorable names. Maybe they could charge him with some sort of new cyber bully law or something for name calling. What has this country come to?

While I think this guy is the lowest of the low, and understand the authorities wanting to lock him up for being a douchebag, I don't see how he has done anything illegal.

Here's my point. FL has their laws about what sort of material is "acceptable" and what is considered "lude" or indecent. Setting aside consideration of 1st Amendment protections for a minute, ponder this.

They set up a sting to order this guys book from him. The purchase request initiated in FL, not CO. So, I could see the buyer (in this case the cops) being charged with the lude material violation, but are we to expect that every retailer/distributor to know all of the laws of every state and what is considered acceptable for that state/county/city? Why isn't the USPS being charged with transporting the lude material into the state? ..the Postman for handling/delivering the material directly? No. And they shouldn't.

By this thinking, if someone in CA purchased a couple of 30rnd AR mag's from me, and I shipped them to the individual, then I should be extradited to CA to stand trial for providing the illegal items.

If FL wanted to prosecute someone for this type of "crime", they should concern themselves with the individual(s) requesting the importation of the material, not the person providing it since it doesn't officially violate the laws of most other states or the Fed.

Yes, the guy is sick and disgusting and I wouldn't shed a tear or lose a moments sleep should someone quietly drag him into an alley and beat him within an inch of his life (not that I'm encouraging such actions, I just wouldn't be bothered by it). Yes, he's guilty of being a despicable and vile sub-human life form, but, is he actually guilty of a crime? I don't think so.

These FL charges simply won't stand. I suspect the pueblo ped will have a good counter suit when it's all said and done. What a waste of time and money. Even FL had to find some obscure law to enforce to make this happen. The book doesn't violate child porn laws by their own admissions to reporters.

Has anyone considered the possibility that the (weak) Florida charges are just a convenient way to get a hold of this dipshit's computer, so that they can find the inevitable stash of kiddie pr0n, and charge him under the federal statute?


He has the same First Amendment rights as anyone else, but as always, with rights come responsibilities, and his rights end when they endanger others.

It is interesting that this guy seemed to give himself up to Florida authorities without a fight. Not something you would have thought he would have done under normal circumstances, if he felt he was in danger of being convicted, is it? It almost looks like he purposely did it to make a mockery of the charges in Florida on 1st amend rights, but any time you go through the system you can get ambushed by a crooked judge or bad jury so that doesn't make much sense either. Why risk it, unless you can't escape it? Can't quite figure out what he is thinking...?

The difference IMO between this guy and a bomb book author, is there is "need" for explosive devices. There will never be need for a book explaining how to seduce children.
