A destructive device is any rifled barrel with a bore diameter greater than .50 inches. On rifles, this is measured grove to grove (50 BMG is .50 grove to grove, but .511 land to land) on pistols this is measured land to land. That means, the maximum caliber of a rifled barrel in a pistol is .50. Maximum rifle caliber is .511. A 28 gauge bore is .550 inches.

Now, if its unrifled, then it can fall under shotgun regulations, but it ends up being either an AOW or a SBS.

So, a 28 gauge pistol is a DD if it is rifled, or its an AOW or a SBS if it's not. There is no legal "over the counter" way to transfer any shotgun/pistol combination that exceeds 410 gauge.

This isn't ATF conspiracy, it's existing regulations. If other 28 gauge pistols have been cleared for import, they will be subject to the same regulations.

Frankly, Taurus is retarded for developing this and not realizing its NFA regulated. While seemingly confusing, the regulations are pretty well known. Most people know that over 50 BMG rifled = DD (okay, some just think it's illegal, but same difference)

Personally, I would never have a use for that gun. It's too big for a pistol and too small for a game gun. It's a product looking for a niche. Waste of metal IMO.
