    I Just find it difficult to believe that the crime rate is Jefferson county is so low that the DA has nothing better to do that to pursue little kids that are playing with legal and safe toys.
    what next? a sexually assault suit filed against a toddler for kissing the girls in his head start class???

    FYI. I know this kid, and other family members know his mother really well. The father is a POS, no matter what you're seeing on the news. The kid was good at one time, but has gone bad due to the mother/father relationship going bad over the last few years. The kid has become a bully in many other situations, and has bullied my son in the past. Read the details of the police reports and other documents if they are available online, it doesn't appear to be an "accident" with the air soft gun.

    I do believe the DA's are going overboard on this though, and the father figure here isn't helping the situation out at all.

    I'm waiting to see Peter Boyles (sp) go out to the county courthouse with toy guns and simulated weapons, I doubt the law will find any humor in the event.

    I have to add this though, I was involved with a criminal case, and Scott Story and his crew were doing the investigation. I am glad they dug deep and got all the facts, it proved a lot of people innocent in the ordeal, especially me. They filed appropriate charges and were going to make them stick. As for this kid, I'm not sure its warranted to go this far with it.

    We'd hang out in the garage and make guns out of PVC that we could use to shoot bottle rockets at each other. More than once my hair caught on fire.

    I still remember my buddy running through a field with a green fuzzy from a roman candle stuck in his hair. He got me back with a shot right to the chest that left a target-shaped bruise; the middle was burned and a bruise ring around it.

    You know, there are plenty of adults that take all their airsoft gear out to hunt each other down and shoot at each other.... Maybe Jeffco should go out and arrest all of them for attempted 1st degree murder.

    My guess is they're throwing the book at him to get a plea deal and avoid court. Hopefully they can scare this kid straight, but I'm not holding my breath.

    God we used to get all camo'd up and use the neighborhood as our battlefield.. BB guns a blazin!

    We'd build launchers out of pvc too.. man there were some grand battles.. only ONCE did a kid come close to losing an eye.. he was fine though.

    WTF is gonna happen when these pussy kids have to go to war?

    No shit.... ............While Airsoft guns are outlawed in my town, I have no issue with my son and his buddy's hittin the numerous field's we have around here for a round of GI-Joe, I only mandate they all wear eye protection and respect the area around them. Oh wait, perhaps its better for my son to sit on his ass in front of the TV playing Wii or X-Box, while pounding down Doritos and soda.

    Another story with Airsoft pellets. This time a kid shot them out of a pen tube (like spit wads). He was expelled from school for the whole year and is facing 3 assault charges.

    The family of a Virginia teen suspended for the remainder of the school year for shooting plastic "spitwads" at students in the hallway is targeting the school district's zero-tolerance policy, claiming that it's "criminalizing childish behavior."

    Andrew Mikel II, a freshman honor student at Spotsylvania High School who also is active in Junior ROTC, is filling an appeal to be reinstated and have his record cleared after school officials suspended him for using what appeared to be the hollow body of a pen to blow small plastic balls at three students during his lunch period last December.

    The 14-year-old initially was hit with a 10-day suspension, but the Spotsylvania County School Board later voted to extend the punishment for the rest of the school year, citing the Student Code of Conduct's requirement that a student found with "any type of weapon, or object used to intimidate, threaten or harm others" be "expelled for a minimum of 365 days" unless "special circumstances exist."

    The district also referred the case to the Spotsylvania Sheriff's Office, which charged him with three counts of misdemeanor assault.

    Mikel says he thinks detention probably would have been more fitting.

    "My son did an infraction and he deserves a just punishment but this is like cutting someone's hand off for stealing a piece of cabbage," he said. "If my son, instead of shooting a spitball, went up and punched a student right in the face he would only have gotten five days suspension and even if he'd drawn blood the school resource officer said police still wouldn't have gotten involved."

    "It takes four state agencies to go after someone with a spitwad: It takes the sheriff's department, the commonwealth attorney, the school board on various levels and the department of juvenile justice … what a fine use of taxpayer resources," he added.
    The kid sounds like kind of an immature dick, after all he did hit a girl with the pellets and when asked to "stop" and "why are you doing that" he responded "Cause I want to."

    But I think detention and a good swift kick in the ass from his dad would be a better punishment. The Dad is right...seems like a waste of time and tax payer money.
