    That's already the case. The government has governmental immunity. If you sue the government and lose you have to pay the governments attorney's fees. If you win the government has to pay yours.

    If you have nothing to lose governmental immunity doesn't mean shit. If you have anything to lose you're probably not going to sue the government. Needless to say the current system is being abused by lawyers due to the fact that there are many people who have nothing to lose. Particularly illegal immigrants who can change their identity overnight.

    I love how lawyers like that are so dirty. I know a ton of lawyers that are good people, many have been defense council (and usually cops don't like them). I have seen a lot of professionalism. It's stuff like that letter that we find disgusting but the BAR association has to be thinking, "What an idiot."

    My Biggest complaint about it is thus:
    Even if this never goes to court. Even as of right now, This bullshit publicity stunt is costing taxpayers at state and county level.

    we the people should counter sue

    Be careful what you ask for. The right to file civil suits is a constitutional right. We already have enough encroachment in that department. Picking and choosing what to encroach and what to not encroach in that document is Russian roullette. Let the system work in this case.

    Two words: Summary Judgment

    If the judge decides that one party doesn't have enough evidence, he can throw everything away.

    Edit: I highly doubt that they are going to find an impartial jury pool anywhere in the metro area. I think a change of venue is likely to find people less...emotionally charged. Thankfully, the facts speak for themselves: the guy could have just stopped, didn't have to lead chase @ 100mph, didn't have to fight, damn sure didn't have to shoot. If someone takes all of those actions and the end result is death, they should expect nothing from anyone...THEY are (were) the problem.
