All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.

That's the first part of the first paragraph of the fourteenth amendment.

I've heard some pretty smart people argue that if someone is here illegally, they aren't necessarily subject to the jurisdiction thereof (simply because they're here illegally and should be deported). Therefore, the 14th doesn't apply.

I'm not an attorney am sure there are smart people on both sides of this issue. But I'm not completely sure the 14th needs to be changed to fix this issue.
