    Default Law I'd enact...

So thinking about it, and I know it would go against certain laws and "rights" but I think this is pretty important since our current system is flawed. Here is what currently happens:
Illegal comes into America, is caught, jailed (at tax payers expense) and deported (again at tax payers expense) and put on a list of not-allowed in. Next time they come in again banned again for 10 years. They can keep on trying and keep getting jailed at cost to you and me.
    My proposal:
1st Offense: Banned 5 years, no jail, just deported, home country notified.
    2nd Offense: Banned for life.
3rd Offense: Held as war criminal and punished for crimes against the American people- IE: Death sentence carried out within 6 months.
Harsh I know, but it would deter them from continuously coming in illegally and not going about it the right way.
Also, to add: if you knowingly and willingly commit a crime against a legal US citizen you are immediately put on death row with the express lane.
Thoughts? I know this sounds harsh, but it's to the point where it's drowning us, we have too many leeching off the system and getting a slap on the wrist. I'm tired of illegals getting 3 hots and a cot on my dime. Maybe if we made it so hostile for them to come here they'd do it the right way. And I would make it so you have to be proficient in English to become a citizen, none of this bi-lingual crap. And if you have children that want to go to school here, they learn English, no teaching in Spanish unless it's a Foreign language class.

How about stopping them from coming in at all. The US is the only 1st world country that has a porous border. I can't even imagine another country allowing the southern border situation we have here.

If you are here illegally you would immediately be deported. Then you can't get back in because we would actually control the border.

Europe has fluid borders. No more border check points there either.

Completely against the 6th ammendment. One of the biggest problems we have is politicians play games with the constitution as it is.

    Really?

Here it is, in its entirety:

"In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence. Just look at europe my friend no visa's at all, just passport and go on your marry way. I have first hand knowledge of this. Heck I have only been stopped at two country crossings there, germany into switzerland and italy into austria. I have driven all over europe and most times it is like driving between states. Pretty porous if you ask me.

I agree, we need to secure the border, but it's so bad right now it's almost impossible to fix with our current budget.

So what you're saying is they have the same rights as US Citizens? I like to think that the 6th applies to US Citizens, not invaders from a foreign country. Look at how many people are in this country illegally and then look at the crimes they commit. Let's not forget, 70% of MS-13 currently in prison are illegals. I'd rather they not be in my jails eating and sleeping on my dollar, I'd rather them be gone... as in gone from existence. I'm sure they will do their best to uphold my rights in Iran! Why should we be different in that regard?

I disagree. The fact is that our current budget is chock full of welfare programs not just to citizens, but illegals, and even worse to foreign countries.

We could have the southern border secured in a couple of months if we really wanted to.

Yes, they do have the same rights as Citizens as defined by the Bill of Rights. The Constitution will specifically say Citizens when it means only US Citizens. And the Bill of Rights protects the inherent rights of mankind from interference by the government.

    P_R:

Spot on; I;ve been advocating this for years.

    ChadAmberg:

Not only that, but our founding document (the Declaration of Independence) clearly states that the universal nature of our natural rights is 'self-evident'. The fact that all governments routinely violate those rights (some more than others) does not negate the existence of those rights.

As you correctly stated, our Constitution's Bill of Rights does NOT establish any rights; it merely defends certain pre-existing rights.

    Both of you:

    Well said.
