Not only that, but our founding document (the Declaration of Independence) clearly states that the universal nature of our natural rights is 'self-evident'. The fact that all governments routinely violate those rights (some more than others) does not negate the existence of those rights.
As you correctly stated, our Constitution's Bill of Rights does NOT establish any rights; it merely defends certain pre-existing rights.
