    Thanks almighty streetglideok for your priceless assumptions and judgement. Heaven forbid someone ask a question about the legality of a situation without having his and his wife's judgement, character and class attacked by the "Holier-than-thou" keyboard moral police. Your definition of class needs a little more thought...

    I'm not sure where you got that information and I would be interested in knowing if you can remember. I've seen their photo radar van on Santa Fe, just north of Evans a number of times and that isn't or wasn't any of the above.

    I've heard Tom Martino and others discuss these tickets, but I have to throw the caveat out there. Not all of them occur in the city of Denver, who I understand doesn't do much follow up. There are cities out there who do attempt personal service for those tickets not immediately paid. Be sure to note which city sent you the notice. It may not have been Denver.

    Yes, it was in the Colorado Revised Statues I mentioned in the OP. 42-4-110.5 (B)(g)(I) or something like that...I forgot to include that they can use them next to parks too...

    Be sure to note which city sent you the notice.
    It was from Denver.

    I got one at the bottom of the hill by my house and a car just naturally speeds up there so I was thinking entrapment. But the picture of the driver couldn't be made out. Couldn't tell who was driving so I ignored it and was waiting for my day in court.
    Its been years and nothing. Knock on wood.

    If you ignore the ticket, the fine will double, collection costs and interest will be added, and they will get a judgement to garnish your wages or bank account. If that is, indeed, a photo of your wife's car with her face and the tag clearly visible -- and it was mailed to the correct address -- they can do this.

    If she was not in that area on that day, or insists she was not speeding, ahe can take a day off from work to hang out with the drunks and druggies for a while so she can have her say in court. She does not need an attorney for this. If she shows up in court to dispute the ticket and it was not in a school zone, 50/50 chance it will be dismissed.

    Bottom line: either pay it or fight it, but DO NOT ignore it thinking it will go away.

    Oh, service through the mail is standard for Denver government agencies. A creditor or private party to a lawsuit needs to have it personally served with a notarized return of service filed, but the DA and traffic control can mail you a subpoena if they want . . . and if you fail to appear they WILL issue a bench warrant for contempt of court . . . even if it was mailed to the wrong address.

    Denver does lots of illegal stuff on a fairly regular basis. That is just they way they do things here. It is effective, expedient, and they decide what rules need to be enforced.

    NO THEY CAN'T.

    If they serve it personally, then it's a real judgement, but since that isn't going to happen (because it's a money loser, and it's all about the money).
    Until then, you are stupid to pay it. It's like a fine for stupidity.

    Any backing to this or is it just a guess? After reading Colorado law regarding automatic radar cameras it is my understanding that they can't do most of this. If you don't pay the original notice then they can send someone to serve you. All they can do at that point is add a fee for the cost of sending someone to your house... No interest, no other fees. Potentially an extra $59. They can't issue a bench warrant, boot your car, revoke your license...they can't even report the ticket to the state. Furthermore, as far as I can tell, Denver is not following state law regarding the use of automatic radar cameras so I can't imagine they will want to bring anyone to court and have that come to light...
