Doesn't matter if it is in violation of the law or not, it doesn't make him at fault for the accident. Plus, the police don't get to decide who is at fault or not.

If you fall asleep at a green light because you are too drunk, and someone rear ends you, even though you are very much breaking the law, you're still not at fault for some one plowing into you.

    and what law/regulation is that?

Because I am pretty sure creating a hazardous situation recklessly is a violation of the law, thus would make it the first guys fault.

I don't understand why this is so difficult to understand. Every driver has a duty to avoid contact with other vehicles on the roadway.

"He was going too slow" is not a reasonable explanation for rear ending someone in your lane. Even if they are stopped.

Obviously the dui driver will get charged as well as the driver who just rear-ended someone.

Lots of people are stressed out these days and are looking for an outlook to release their anger. This economy, unemployment and government cluster f**k going on is stressing people out.
It seems like I am personally involved or see other drivers involved in road rage just about every day. Sometimes, it’s hard for me to just chill and move on, I would like to check some a** hole in the highway barrier every once in a while.....

Maybe I need anger management class........ again!

Is there a group discount? How about a frequent flyer's club?

I agree with TF... Sign me up too. I encounter it every morning on my way from Lakewood to Evergreen on WB I-70. I actually got flipped off yesterday for flashing my lights at a guy doing 50 in the left lane (where there are very clear big white signs with black writing that say "Left Lane Minimum Speed 55")
