It was always taught to us that a war crime is a war crime regarless who issued the order. Which is why they give "Law of land warfare classes" at least they used to.

I agree that it is probably a war crime, but I do feel bad for the young soldiers who think they are doing right by following orders and don't understand a lot of things about the world, law, or crime yet. They are charged with fighting a war they often don't understand and get punished for it.
They know it's wrong. Like I said for years they ingrained us what war crimes are/were, and I haven't been in long. They always had that caveat that orders don't excuse actions, hence the phrase "lawful order". Now I don't have all the details (obviously) to accurately comment, but shooting an unarmed person is wrong, even if it was aginst a "hostile force" i.e. No ROE needed.
With that said though, these wars aginst guerillas are complicated, with the ROE, and sometimes it isn't clear. However if these are the same assholes I think they are then the reports werethat they were just killing for no real reason or military necessity.

I have to say I don't condone what he did. But I feel sorry for him and other kids just like him who have to sort out such complexities on a daily basis and under a lot of stress.
The whole thing is just sad.
