    Default NFA toys = unwarranted searches?

    A guy my dad works out with was apparently telling my dad that he'd get a suppressor EXCEPT that going through all the paperwork and stuff, at least here, means you're signing off to the sheriff's department that they can search your place at any time without a warrant. I've never heard about this in any state or county. Is this the situation or what? If I ever have a thousand bucks lying around sometime I'd like to pick up a can for my AR, but this makes me a bit leery.

    Tell your dad to tell that guy he needs to put down the crack pipe and call the Betty Ford clinic.

    On a form 4 it says and I quote:

    " I certify that I am the chief law enforcement officer of the organization named below having jurisdiction in the area of residence of (insert name)
    I have no information indicating that the transferee will use the firearm or device described on this application for other than lawful purposes. I have no information that the receipt or possession of the firearm or device described in item 4 would place the transferee in violation of State or local law

    (signature)"


    The sign off is just stating that they have no information to make them think you will use the NFA weapon for illegal purposes and that by being in possession of it you will not be in violation of any state or local laws.

    ATF can not search my house with out due cause and the Sheriffs dept. sure as hell can't either.

    Interesting, thanks. I wonder where this dude got his info. He seems to be reasonably knowledgeable otherwise, but I haven't met him personally so I dunno. Good to know that Form 4 doesn't mean signing your rights away. :mrgreen:

    A LOT of people get things confused, they confuse owning an NFA Title II weapon with being a dealer. As a dealer you do give up that right, but only on the business premises and only in regards to your inventory and logs. I think there is a limit of 2 "unannounced inspections" per year though. People hear rumors about this, and not understanding that owning a machinegun does not mean you are "licensed". In some states the ONLY way to own a Title II item is to be a dealer. Hence, all the confusion by the average person. Karl.
