Can we all agree that smoking is bad for your health? Yes? Good! So is living in the city, using a cellular phone, sitting within two feet of a computer, watching TV, using the microwave, driving a car, breathing, taking a shower... everything is potentially a deadly activity. Hell I could die just sitting on my couch watching a hunting show on TV! The point is, and I see both sides of the argument, that while yes, the OP's story shows how terrible parents smoking in the car with infants are, but there should be no laws or other liberty restricting mandates put forth to make anything regulating behavior a legal matter. Once that happens then it might not stop. First we started with texting (this I agree though) but what next? No talking on the phone without a handsfree device like they have in many states already? Then it could spit ball further- no eating, no talking to passengers, no smoking? Remember this is our government we're talking about, they've tested it for years and now they're just like that story: If you give a mouse a cookie.... he's gonna ask for a glass of milk. Don't give them an inch, you know they're going to take a mile!
