    Default i have to move yet again....

    i was notified yesterday that the management of my apartment changed my lease yet again in the middle of the lease term, without warning.

    i came home yesterday to a notice on my door stating that the apartments no longer allow certain breeds of dogs, including but not limited to, akita, rotty, doberman, and pit bull. then under that paragraph it says quote:

    "in addition, any animals with the following attributes are ineligible:
    guard dogs or attack dogs: german shepherds, HUSKIES, alaskan malamutes, great danes, and st. bernards.
    this list is not inclusive please let us know what pet you have if there is any question."

    anyone who knows anything about huskies will tell you they are about as good a guard dog as a hamster, i am sure if someone broke in my house when i was not home my dog would be more than happy to help the BG out the door with everything i own without giving more than a playful grunt.

    the only thing this dog has attacked in his life was his food bowl and my couch when i was at work.

    so i now have 30 days to move, or get rid of my dog, theres about as much chance of me getting rid of my dog as there is of giving up my first born. what pisses me off most is i just moved in here 3 months ago and they had no problem with me having my dog, had they said something then i would have moved into a house and been done with it.

    Huskies? Why don't they just throw poodles in there too. :roll: And my German Shepard is the same as your Husky. She'd chase the cats out of the way so the bad guy wouldn't trip over them.

    i forgot to mention that my dog is blind (only 1.5 years old), requires daily medication, special care and would most likely be put down if i got rid of him. im sure there is nothing i can do short of moving, but when i move i will have to pay a months rent ($950) for breaking my lease :roll:, on top of what ever it will cost to move into a new place.

    A lease is a legal document
    It can't be changed without BOTH parties written agreement (and it's a real estate deal so it has to be in writing, oral agreements aren't valid in real estate)
    you have a leasehold agreement on that piece of real property until your lease expires.
    They can do whatever they want, but what you signed still holds.

    i will be contacting our lawyer tomorrow, he has been out of the office all day. i have read the lease a few times now and it is really vague but it does state that they have the right to change certain rules as long as they give 30 days notice. it however does not say which rules they can change or to what extent.

    this notice is a new pet addendum, i signed one when i signed my lease, the manager made it clear that they would go ahead with the eviction after 30 days if i dont get rid of the dog (sign new addendum) or leave. i am actually quite impressed with the a-hole, i tore into him on the phone pretty good this morning, i was sure he had hung up on me a few times but he stuck with the hole reaming to the end :cool:.

    i did however email the cliffs notes version to the tom martino help line, along with a huge list of stuff they should be held responsible for. not sure if it will make any difference but i can say i tried a few avenues before giving up. at worst they may spread the word so no one else moves into this crap hole.

    Tell them you have a mutt that way he doesn’t qualify for any of that BS. I agree with Brian you signed a lease and it is a binding legal agreement. The problem is I bet if you read the fine print it says they can change their end of the deal at anytime.

    i just talked to our lawyer, he told me basically the same as JohnTRourke did above. we signed the lease, they knew what breed of dog we had, and we paid the deposit. i am supposed to set up an appointment with the lawyer for tomorrow or the next day, i still have very little hope they would let him stay.

    at this point i only want to be able to move out of here without having to pay an extra months rent for them breaking my lease. if i have to pay that fee it will be very hard for us to get enough money to find a new (acceptable) place in the time frame we currently have.

    my choices of areas to move are currently limited to a few (maybe 5) miles from here, my little sister lives with me and she is still in high school, and i have to drive the opposite direction of her school for work. and my girlfriend is trying to get a job at the post office in this area and has no car. so basically i am pretty screwed at the moment :cool:.

    so depending on how someone interprets that, it could be anything they think may have been bread from a wolf, which in all reality (at least the way i have always understood it from biology class) is every dog in existence.

    Actually every dog in existence came from a Dingo believe it or not.(except wolf hybrids) I was just being a wise arse anyway and that is probably what I would have said just to be a smart arse.

    I hope you get it worked out as I would live under a bridge and eat $hit before I gave my dog up. I have a friend with two husky’s how anybody could ever in a wet dream even consider them aggressive is beyond me.

    Let the lawyer look over your lease and see what he can do. If all else fails the one thing on your side is housing is in a slump people are begging to rent. :cool:
