    The trust willmaker will generate for you is going to be a valid trust - that doesn't make it particularly suitable for use as an NFA container.

    Examples: Most vanilla trusts specify that trust assets are to be sold to settle the grantor's debts. You probably don't want that happening with your NFA goodies.

    Most vanilla trusts contain boilerplate clauses about careful stewardship of trust assets, which is kind of at odds with you regularly using and thus devaluing the SBRs and suppressors- maybe causing a baffle strike or having a KB.

    There are a bunch of other things which may be particular to different boilerplate trusts, or peculiar to each state's trust laws which may not be suitable for your uses. Those trusts will be valid, legal entities which can own NFA, but encumber your usage of the items if things ever got unhappy between you and other trustees.

    Using a lawyer will let you look for pitfalls like that which you would like to do differently for a trust whose assets you're intending to use and share with other trustees, etc. If you don't give a damn, or are just cheap, then use willmaker or a boilerplate handed out by some gunstores.

    I used Rose on the western slope as well and the stamp came back approved. Here fee was very reasonable compared to others. Think it was $350. Just felt better not risking having something wrong. If there is/was I can blame the lawyer and have it corrected. Not too mention 6 months is long enough to wait and then to have your app kick back because somthing was wrong, would suck.

    Those were my thoughts too. Sure, maybe a $10 trust would be ok, but for peace of mind, and recourse if something goes wrong, it's worth it to me. When you consider the length of time over which the cost will be spread, it's pretty cheap insurance, if you believe in insurance.

    Given the expense of playing with NFA toys, and the legal pitfalls of not playing with the rules correctly, I can't imagine why anyone would use a computer legal form generator to create an NFA trust. Its really a bad idea.

    I used Willmaker, but to be honest, I wish I had gone with an attorney. Just for peice of mind. A good friend of mine (attorney) is actually getting all set up to do NFA specific trusts. I'm going to have him give it a good once over since he's such a sharp dude.

    Does anybody know for a FACT if anyone has got in trouble with a trust from a program like Willmaker? I'm not talking about a story you heard or read about on the internet. But actual facts of the arrest. From what I understand, it would be public information if it went to court.

    Not to bag on the boys at the ATF but they are NOT lawyers.. a trust is a trust is a trust to them.. however, to the DOJ or some local DA.. the difference in wording could be rather costly... having to defend your own actions in court is $$$$.. someone who carries malpractice insurance.. well let them worry about that.

    Will do. He's in Loveland. So he's relatively close and will be cheaper than anyone I've seen so far. He just finished one for a customer who ordered a Thunderbeast from us. I told him I wouldn't post his contact info until he gives me the OK. Should be soon.
