    Default Question about purchase legality

    I have a relative in town this week from MD and he's been talking about checking out a couple of local shops and wanting to purchase a firearm.

    First, is this even legal since he's not a CO resident? If he can purchase it, does the shop need to send it to his local FFL where I would assume that he'd have to go through the same hoops as if he was to purchase the firearm there?

    Second, is it legal for him to be involved in a private party to private party transaction since he is not a CO resident?

    I think (and what I've advised him to do) is that it would probably just be easier for him to wait until he got home and purchased what he wants there. I just want to make sure that I was right in doing so.

    yeah, if you are not a resident, CO dealer will not allow the purchase. As far as private party to him... im not sure of the legality, but if you knowingly purchased it to sell to him, i beleive that is a violation as well. if you want to stay on the right side of the law, you are best to tell him to wait till he gets home.

    Of course if its just something he wants and cant get there, but its legal to own, an FFL transfer to his state is always an option.... just like gunbroker or something, he buys it, the FFL here ships to a FFL in his state where it is transferred to him.

    That's pretty much what I was thinking, I told him I would double check though. I already warned him that getting someone here to buy it for him would be cause for trouble (IIRC, it's even a question on the form). But he's thinking of buying something from an in-law that's here which is why I ask about the private party transactions.

    he can purchase any long gun (legal to own in home state) he wants from a FFL. handguns however he cannot purchase w/out an in state ID. there is nothing illegal with you buying him a gift PROVIDING he is able to own a firearm and it's legal in his state of residence. However going into a store with him looking/handling a gun then you buying it (if i was at the counter) would constitute a straw purchase and you would be in violation of the law.

    another option would be to buy off paper. there is nothing illegal with receiving a gift.

    Jim is 100% correct.
    If he can legally own the firearm in his home state, he can buy a rifle or shotgun here.
    MD doesn't like anything over 20rds in a rifle mag, but he can still buy an AR here. No problems.
