    Default Question about Misdemeanor 3 on NFA

    So a close family friend is in the final stages of his ATF Form4 paperwork, however, there was a bit of confusion that caused for an ATF letter to be sent to him regarding his NFA paperwork for an SBR. This same issue came up with his first pistol purchase at 21 and had to be clarified by JCSO. When he was younger he was charged with 2nd degree arson and it was pleaded down to an M3 Criminal Mischief charge. The ATF sent paperwork back and he has all of his JCSO paperwork proving he wasn't in fact convicted of Arson2, but instead an M3 lesser charge. Is there any reason he could suspect that his NFA paperwork would be denied for this? We talked in great detail about this tonight, and he's just worried about having to jump through hoops to get a refund and all that for his SBR. Thanks.

    If he's previously cleared NICS for firearms, there's no ATF reason a Form 4 wouldn't go through. If he's doing it as an individual and CLEO refuses to sign because of M3, then he'd have to go trust or corporate route, for now, to bypass CLEO sig requirement.

    That's what I thought. He already got CLEO signature months ago, I think it's pretty much send in his Jeffco Court records to ATF and they approve and he can pick up his SBR when that's all done. Now if only the postal service moved like they actually had a purpose.
