    This was debated yesterday in the hearing. The way the bill is written the FFLs can only charge $10.00. There is nothing in the bill that allows an FFL to refuse to do the transfer or charge more than $10.00. If a NICS fee/tax is imposed that would be above the $10.00 listed in the Bill.

    Totally. One of the biggest arguments against the checks last night was how long it takes and how unjust it is for people needing a gun immediately for whatever reason to have to wait weeks. Or at least that was one of the few arguments they showed any interest in. If they can reduce wait times to a more reasonable level, it will be one less argument in the way.

    I wouldn't be surprised if CBI got a call last night that opened up overtime or something.

    I could have missed an amendment but there noting in the bill that requires them to do it. All it says is that you cannot transfer without getting a BG check. Hell you cant even loan your friend a gun unless you are at a State Approved venue.

    5 required - penalty. (1) EXCEPT AS DESCRIBED IN SUBSECTION (6) OF THIS

    I was thinking the $10 would be a fee to CBI and then they would charge there transfer fee on top of this. I can't see many FFL's agreeing to do $10 transfers. I think most would stick to new gun purchases only and avoid person to person transfers.

    So I read this as it is $10 to do the BGC but they can still charge you a fee for transfer on top of this.

    Did they make any exceptions for CCW holders. I know Florida has something similer. If you have a CCW you don't have to do the BGC (for dealer purchases)

    sorry we don't do transfers but you can sell the gun to the store and we'll sell the gun to your friend there at a $50 markup +sales tax.

    The way it is written the FFL must, by law, perform a background check to transfer a gun between two private parties. Hell, as it is written, they must do it if someone knocks on their door at 2AM to wake them up to do it.

    This is where things could get really bad- and I think that's the Dem's point- what happens when no FFL wants to do the transfers anymore? Then no guns get sold this and effectively the State has just created a micro-black market. Oh and of course this does absolutely nothing to curb violence, or crime.

    Yes, and no exceptions for CCW, that's come up 3x and every single time it's been shot down. Seriously, the democrats don't like us gun owners, so they can go f*** themselves.

    Where does it say that? Maybe im missing something....All This says is that non-ffl shall/aka must get a BGC. Nothing requires a FFL to do so.

    It was discussed yesterday, brought up by numerous witnesses and Republican Reps and confirmed by the bill's sponsor and author: an FFL would be REQUIRED to perform the background check, by LAW.
