    MESA COUNTY RESOLUTION NO. MCM 2013-009

    A RESOLUTION TO PRESERVE AND DEFEND THE SECOND AMENDMENT OF THE UNITED STATES CONSTITUTION OF THE BOARD OF COUNTY COMMISSIONERS OF MESA COUNTY, COLORADO

    WHEREAS, the Second Amendment of the Constitution of the United States of America states that “A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed”; and

    WHEREAS, the Supreme Court of the United States in two recent cases, District of Columbia v. Heller and McDonald v. Chicago, has held that the right to keep and bear arms is an individual right; and

    WHEREAS, the Board of County Commissioners of Mesa County, Colorado desires to adopt a formal Resolution to preserve and defend the Second Amendment of the United States Constitution.

    NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of Mesa County, Colorado, sitting in a duly called session on this day, that: The County of Mesa, Colorado will not enforce any unlawful and unconstitutional statutes, executive orders or other regulations and proclamations which conflict, and are expressly preempted, by the United States Supreme Court’s rulings on the right of an individual to keep and bear arms; and

    BE IT FURTHER RESOLVED, that the Board of County Commissioners of Mesa County, Colorado calls upon the United States Congress, the Governor of the State of Colorado and the General Assembly of the State of Colorado to preserve and defend the Second Amendment of the Constitution of the United States as an individual right of the citizens of the State of Colorado and to nullify any statutes, executive orders or other regulations and proclamations that infringe on the right of an individual to keep and bear arms.

    DULY MOVED, SECONDED AND PASSED this 11th day of February, 2013 by the Board of County Commissioners of Mesa County, Colorado.

    I wonder what this means exactly? Can I own an M-16 (100 round "clip") full auto in Mesa County with out worry?

    If you purchased it under NFA rules yes. If purchased otherwise the ATF might have something to say about it.

    It'll be interesting to see if these different jurisdictions put their money where their mouths are in relation to the trash that's about to be passed in the Kolorado senate and signed by Hickenloopy.

    Similar to the El Paso resolution. I'd like to hear from someone in the know about enforcement.

    My guess is, it really doesn't mean shit unless the city and people stand to back it from the GOV that says otherwise....... But what do I know??

    ONE more way the MSM ignore reality and just how many people across a wide spectrum are AGAINST GUN CONTROL. I don't see this being reported on any of the local abcBSbc affiliates, or in the denver stump. YET boulder enacts a pets have equal rights, or a smoke free outdoors and it's on every $%^& media outlet.
