But when the President directs his AG to not enforce a law (in the case of MMJ- the controlled substances act), then you have what we have here in Colorado.
If a DEA agent wanted to bust anyone in this state for MJ, they technically still could, it is a federal agent and federal jurisdiction. But don't expect it to happen.
More interesting is the Arizona / Immigration case, IMHO. There you have the state enforcing a law the Federal government has written but chooses not to acknowledge, or more accurately, willfully disregards.
Edit: A smaller government can be more restrictive, but not less.
