at this point the city has a judge involved. Now you gotta show up cuz the last thing in the world you wanna do is piss off a judge.

Ginsue said that they can't compel you to rat out the wife... I also believe this is true but I dunno how to do it exactly ( with out pissing said judge off)

next time just trash the damn thing and wait to see if the cops knock on your door and serve you with it . while this MAY happen I've not had it happen to ME or anyone I personally know how has trashed the tix.

Wow, some high and mighty people here on this forum. Feel free to sit in your chair at home and play perfect... There are absolutely weather conditions and car timing where going through a red light is acceptable and is the safer choice. I've got video evidence of it with this ticket. But you're probably the type of drivers who see it go from green to yellow and slam on the brakes, causing an accident for the person behind you. But of course it's not your fault in the eyes of the police or the insurance... people will be calling you asshole behind your back.

Now, considering I'm the one on the ticket, I didn't commit the crime, and I consider those red light cameras ILLEGAL (they threaten you without any legal footing), I'm not willing to pay the fine. And I damn sure am not going to "turn in" my wife.

I came to this forum asking for advice, not your judgement. Go somewhere else.

I am not judging at all and I even agreed to a post that explained how it could be handled to possibly get out of it. But the fact is your wife did run the red light. Would you be asking the same question if she ran it because she just didn't notice it change? Or was in a hurry to get somewhere and decided it was safe to run it? We all make mistakes and incorrect decisions at times and we should all be prepared to pay the consequences of those decisions.

They are "no point" tickets and do not appear on your driving record regardless of final outcome.

Excerpts from C.R.S. 42-4-110.5:

(II) If the state, a county, a city and county, or a municipality detects any alleged violation of a municipal traffic regulation or a traffic violation under state law through the use of an automated vehicle identification system, then the state, county, city and county, or municipality shall serve the penalty assessment notice or summons and complaint for the alleged violation on the defendant no later than ninety days after the alleged violation occurred. If a penalty assessment notice or summons and complaint for a violation detected using an automated vehicle identification system is personally served, the state, a county, a city and county, or a municipality may only charge the actual costs of service of process that shall be no more than the amount usually charged for civil service of process.

(e) The state, a county, a city and county, or a municipality may not require a registered owner of a vehicle to disclose the identity of a driver of the vehicle who is detected through the use of an automated vehicle identification system. However, the registered owner may be required to submit evidence that the owner was not the driver at the time of the alleged violation.

(II) Except as provided in subparagraph (I) of this paragraph (d), an automated vehicle identification system designed to detect disobedience to a traffic control signal or another violation of this article or a local traffic ordinance shall not be used unless the state, county, city and county, or municipality using such system conspicuously posts a sign notifying the public that an automated vehicle identification device is in use immediately ahead. The sign shall:

(A) Be placed in a conspicuous place not fewer than two hundred feet nor more than five hundred feet before the automated vehicle identification system; and
(B) Use lettering that is at least four inches high for upper case letters and two and nine-tenths inches high for lower case letters.

Interesting that I have to prove my innocence... I guess its time to go find those signs and qualify them (though I don't expect an issue). I can't figure out any way to submit evidence that I was not the driver at the time. I suppose I could see if I could get photographic evidence from another traffic camera that it wasn't me? Though at that point, it would show my wife. I might be able to show my iPhone was at home, though I'm not sure I could prove that the iPhone was with me at the time.
