DENVER — The U.S. Forest Service is proposing new rules that would require commercial photographers and videographers — including news media — to apply for expensive permits before working in wilderness areas.
The permits would cost up to $1,500 per project, and the Forest Service could refuse any projects it deems inappropriate. If the Forest Service determines that a person has used images taken in wilderness areas without permission, they could be fined more than $1,000 and forced to recall the images.
Someone needs to be reminded that those are PUBLIC LANDS.... My land. your land NOT THE GOVERMENTS LAND!!!!!!

I seen this earlier and thought it was a joke at first. Where the f'k do they get off? And this from the same people that say you have no right to keep your image out of their databases or to video privacy when in public.......
The argument will be that you are making money from the photos because you are a commercial enterprise. Same as requiring a permit to be a street performer in a park. Still don't think I like it.

perhaps...
But you know it will be abused and cost you more in lawyer fees to prove your not a commercial enterprise then it would have to of gotten the permit to take your family vacation photos.

They already do this in national parks and it's BS. If a shoot is big enough to require road closures or rangers on set then they should be billed for it. Not a blanket policy.

Yes, if you do something that requires extra Government expenditures above and beyond normal operating budget. Just like all the yahoos who do stupid things that require a search and rescue.
If you are just capturing photons from outerspace that are bouncing off of Land that is OURS, then no.
I'd love to do it and take it to court. There is no way it will stand up to a judge.

In this day and age in post-constitutional America, that is a foolish and naive statement.
Seems like a first amendment issue could be raised. So this means that news organizations have to pay the goverment to report what happens on PUBLIC lands? I don't see this sticking.

"Commercial use" and "Editorial use" are two different legal distinctions under copyright law.
Is the forest service involved in copy writing now?
On a side note, there goes every wilderness Youtube video ever.

I think this may be a bunch of uproar about nothing. Here is when a permit is required.
45.51a - Permit Requirements
A special use permit is not required for still photography when that activity involves breaking news (sec. 45.5).
A special use permit:
1. Is required for all still photography (sec. 45.5) activities on National Forest System (NFS) lands that involve the use of models, sets, or props that are not a part of the natural or cultural resources or administrative facilities of the site where the activity is taking place.
45.52 - Commercial Filming
45.52a - Permit Requirements
1. A special use permit is required for all commercial filming (sec. 45.5) activities on National Forest System lands (NFS). A special use permit is not required for broadcasting breaking news (sec. 45.5).
c. Commercial Filming. Use of motion picture, videotaping, sound-recording, or any other type of moving image or audio recording equipment on National Forest System lands that involves the advertisement of a product or service, the creation of a product for sale, or the use of actors, models, sets, or props, but not including activities associated with broadcasting breaking news. For purposes of this definition, creation of a product for sale includes a film, videotape, television broadcast, or documentary of historic events, wildlife, natural events, features, subjects or participants in a sporting or recreation event, and so forth, when created for the purpose of generating income.
d. Model. An individual who poses for the commercial filming or still photography of a product or service for the purpose of promoting its sale or use. A model may also include inanimate objects, such as vehicles, boats, off-highway vehicles, articles of clothing, food and beverage products, and so forth, placed on National Forest System lands so that they may be filmed, photographed, or recorded to promote their sale or use.
e. Sets and Props. Items constructed or placed on National Forest System lands to accommodate commercial filming or still photography, such as backdrops, generators, microphones, stages, lighting banks, camera tracks, vehicles specifically designed to accommodate camera or recording equipment, rope and pulley systems, rigging for climbers, and structures. Sets and props also include trained animals and inanimate objects, such as camping equipment, campfires, wagons, and so forth, when used to stage a specific scene. A set or prop does not include any of the preceding items when they are used to report breaking news, nor does a prop include a hand-held camera or a camera mounted on a tripod.
I say go for it but only if they give me free hunting licenses!
Here is the public comment page: https://www.federalregister.gov/articles/2014/09/04/2014-21093/proposed-directive-for-commercial-filming-in-wilderness-special-uses-administration
Be heard loud and clear but PLEASE do not revert to childish means, we were hurt in the NFA public comment this year by that stuff.
If your afraid to put in your personal info, do not worry they already have it on file. Just do it.
