Since the gun is clearly jammed and out of battery the entire time I wouldn't have been all that worried.
I still would probably have shot him anyway :p

Dumbass was lucky the clerk wasn't armed, he rode the slide and it stove piped the round.
Bwah. I might have taken it from him and pistol whipped him with it.
Also, more proof why you don't carry a handgun with an empty chamber.

I would have cleared it and shot the robber with it. But then I would have been fired from Jimmy John. I guess it would have been win-win though.

The Dindu that robbed me almost 20 years ago drew his little .25 from his pocket and with much flourish and exaggerated movement racked the slide before pointing it at us (which would get him shot by me today instead of just standing there in condition white like I did in my youth).

Does it add argument for a lesser charge if not chambered? I've never looked into the minutiae of how to catch a lighter sentence when committing a felony.
Clearly, the robber flunked out of Rocket Science school. I mean, what kind of idiot robs a frickin Jimmy Johns? He got maybe a hundred bucks, and then got caught?
I think a real gun that isn't loaded carries the same penalties as a toy gun. Which I believe is the same as a real gun, loaded or not.

I say go big or go home. I wouldn't rob anything less than a bank.
The employee was probably thinking "what an ass clown he jammed his gun and doesn't know it!" I would have been worried if he successfully got a round chambered since he had his booger picker on the trigger the whole time. The employee was really calm like it wasn't his first rodeo.
Some guys tried to rob the Papa John's I was working at a few years ago. They came in and were so scared that none of the employees realized that they were trying to rob the store. I think at one point when the manager realized what was going on he actually said to the guy, "Are you kidding me?" One of the employees was around the corner and ducked into the back to call the police. That employee said he saw a gun, but the other people weren't even sure. Anyway, one of our delivery drivers came back from a run right in the middle and the robbers thought it was the police showing up so they bolted out the front door. When they got outside and realized our delivery driver wasn't the police, they timidly tried to rob him as well. He told me that they were demanding his money so softly that he didn't know what they were asking him. He just locked his car and kept walking inside. It wasn't until he got inside that he was able to figure out that they had tried to rob him. I was actually working that night, but got to go home early because it was slow. I think this happened within an hour or so of me leaving. I was carrying at the time and glad that I missed the whole event because there is a decent chance that I would have reacted to the sight of a gun by drawing my own. It would have weighed pretty heavy on me to have shot such bumbling fools who were clearly not yet career criminals and I'm thankful to have avoided the whole situation by not being there.

There's members of this forum who carry with an empty chamber. You're carrying a gun and don't have it hot?? That's like putting as condom on AFTER you're done [facepalm]

That's a possibility, but I think its really two things. 1) they're packing "Mexican Carry" and don't want to blow their own junk off and 2) They watch a lot of movies and the act of racking the slide is part of the whole "Robbery Show" they're putting on.
My guess is the real hard core killers have loaded chambers and topped off mags.

Probably didn't even have the right ammo in it. I'm sure a lot of those geniuses think "bullets is bullets".

He ordered a Slim Two, which is just roast beef and bread, and then he asked for what type of cheese I had, and he was like, "Ah yeah let me get some cheese then.' Then he ordered chips too, and then proceeded to try to rob me like a bitch.
I wasn't really that worried about it to be honest, he didn't seem that intimidating I guess. I just wasn't that scared. If I had known 100 percent that the gun was jammed, I probably would have grabbed it out of his hand whenever he leaned over the counter like that. He was like, all the way over, off-balance.

If the employee took any action then JJ's would have fired him. But then once fired he could take his frying pan with him out to the parking lot. I'll take a frying pan over a stove pipe :P
I DEFINITELY would have eaten that dudes sandwich after he left, even though it didn't sound very good.
