Justin Smith (http://www.facebook.com/SheriffJustinSmith?ref=stream)
I just read the joint news release from Colorado House and Senate Democrats. The following information is from their very own release.
The propose:
-to fine citizens $5,000 and jail them for 18 months for selling a gun without the state's permission.
-to fine citizens $1,000 and jail for 1 year for possessing, selling or trading any magazine capable of holding 10 or more rounds of ammunition. (the only possible way to avoid being jailed under this proposal would be to register current ownership of these magazines with the state.)
Decide for yourself if you think these proposals are radical.

Just sold the Harley yesterday. That's gonna go a long way towards a one-way ticket to Idaho. I can't get outta this liberal-infested state fast enough.

Not only is that shit cray, but its untrue:
This bill will ban the sale, transfer, and ownership of all new ammunition feeding devices (magazines, strips, and drums) capable of accepting more than 10 rounds, after the enactment date of the bill. Additionally, it will prohibit the sale or transfer of large-capacity ammunition feeding devices lawfully possessed on the date of enactment of the bill.
I should know better than to believe a facebook post.
As it stands a state magazine ban is unenforceable, all you do is have your friend from Texas ship you a gaggle of pmags and if they ask, you owned them before the ban. Its ridiculous and ineffectual.
So much of this is just plain stupid and will make literally no difference the next time some deranged bad guy comes bursting through the door wanting to kill people. Constitutional carry would go a lot further to make our streets safer from both normal crime and spree shooters.

Here's someone who's data and methodology I am smelling at a little...off.
A national survey by pollster Doug Schoen found that 72% of voters support banning high capacity ammunition magazines, or gun clips that hold more than 10 bullets at a time. The survey also found that 59% of gun owners and 47% of NRA members agree with this ban.

Keep in mind that Doug Schoen is a Democrat operative. The fact that he and Pat Caddell have NOT publicly left the Democrat party over the things both of them complain about on Fox News is de facto proof that much of their anger at the Democrat party and its policies is contrived. They both make a ton of money pretending to be "disaffected Democrats".

From the CO Senate link:
PROBLEM:
High-capacity magazines were designed to for one thing -- killing large numbers of people quickly. They have no place in our communities and on our streets. Mass shootings in Aurora, Newtown and Tucson have demonstrated all too clearly the need to regulate high capacity ammunition magazines. These weapons allow a gunman to fire a large number of rounds quickly and without having to reload. Americans can legally buy more firepower than the U.S. military gives its service members on the battlefield. The standard basic ammunition load for an American soldier fighting in Iraq was seven magazines with 30 rounds each. The Aurora shooter used a drum with more than three times the rounds of an American soldier.
So 7*30=210 rounds and his drum held three times that? 210*3=630 Imagine how heavy that rifle would be. Thinking they meant the drum holds more than 3 times what a single magazine does, but the wording suggests otherwise. If I had all the firepower I had in the Army I'd have a Black Hawk helicopter and a couple of M-60D machine guns and some hand grenades, not a semi auto M4 clone.

And... Didn't the Aurora shooters hi-cap mag jam? Wouldn't that mean that hi-cap mags are safer?

Idiots. Do they have any idea what precedent this will set -
Remove Colorado statutes that exempt manufacturers, importers and dealers from their responsibility for the damages done by their products.
Are we going to go after our local brewers (Coors included) for DUI related deaths and accidents? These people haven't got the slightest clue as to what problems their new legislation is going to cause. Not a clue.

You're right, fell into the FB trap myself. I read and re-read, nothing regarding that ...but the only way to prove any of that would be some sort of stamp/serialization.
this stinks, stinks very very badly, but the thing I don't understand is how do they possibly think they can ban sale or transfer of ownership? Magazines listed in my NFA trust now? this reeks of stupid. I step across the state line and they get to fly a kite.

Since handguns, shotguns and bolt action rifles are exemt, does that mean 13, 15 and 33 round mags for handguns are okay to possess? What about Saiga mags, 20 round mags for the Ruger bolt action rifles? Confusing on it's face to say the least.

The problem with gun control bills is that they are written by people who don't like guns, and therefore don't know enough about guns to explain the regulation in a fully intelligent and complete fashion. I guess that they can't even find a competent gun-knowledgeable person who is willling to sell their soul to the devil and write their bill for them. Oh well, more shoulder things that go up...

Just don't include Sen. Tochtrop in this bunch. You may not like her new bill to mandate face-to-face CCW training, but she is one of the reasons we even have a "shall issue" CCW program in this state.
In-Person Training for Concealed Carry Permits -- (Senator Lois Tochtrop, Representative Jenise May)
The legislation specifies that concealed carry permit holders, who are not exempt from training, must undergo training in-person. It prohibits training from being done online.
She will also be vital in stopping some of the other junk from getting passed.
All the others can go...

Yes, there is. It is entitled: Protection of Lawful Commerce in Arms Act, signed into law in 2005.
Edit to Add: The Supremacy Clause of the Constitution should render any passage of that Colorado law void - though probably not before a protracted legal battle.

I think we need one organizer to pull efforts together. If it operates like the constitutional amendments did, then someone has to write the petition, notify the SoS of intent to place it on the ballot and then they have a limited time to collect sufficient signatures to place it on the ballot. I'd probably suggest a separate petition for each legislator but with similar wording on the reason and cause. That way the NIMBY beeches can sign the petition to remove all the anti-gun assembly members but their own and we might still get enough signatures to get on the ballot. THIS is what RMGO or CSSA could spearhead and actually do something productive with.
So, how do they plan on enforcing the magazine restriction? Are they going to serialize every 10+ magazine and track them in a database? I have a couple hundred of them.
The liability on owners is kind of scary. So, if somebody steals your AR stored and locked away in your home and kills somebody, you will be destroyed financially for the rest of your life. However, if they kill somebody with your baseball bat, knife, or bolt action rifle, that is perfectly acceptable...sounds reasonable. What a bunch of BULLSHIT!!! [Rant1]

The details are here http://ballotpedia.org/wiki/index.php/Laws_governing_recall_in_Colorado
basically it says:
Signature requirement
The number of valid signatures required to force a special recall election is 25% of the votes cast in the last election for the official being recalled.
Filing for recall
First a recall petition must be filed with the office in which nomination petitions are filed for the official that is being recalled. Generally this office is the Colorado Secretary of State. The petition must include a statement of no less than 200 words explaining the ground on which the official is to be recalled. This measure is for the benefit of citizens who will sign the petition.
Circulation
After the petition is approved by the Secretary of State, circulation of the petition may begin. Petitioners have 60 days to gather the proper number of signatures. After the proper number of signatures have been gathered the petition is submitted to the office in which it was filed to be deemed sufficient. This entails verifying the signatures. Once the petition has been deemed sufficient, the office in which it was filed will deliver the petition along with a certificate of it's sufficiency to the governor who will then set a date for the recall election.
Recall election
After the petition has been deemed sufficient, the official against whom the recall was filed may resign within five days without having the recall election held against them. if the official does not resign the recall election will go on as scheduled. The election will be held not more than 60 days after the petition was deemed sufficient but not within 30 days after. However if a general election is within 90 days of filing, then the recall elcetion will beheld in conjunction with the general election.
The ballot will include the original statement from the petitioners as to why the official in question should be recalled, as well as a no more than 300 word rebuttal from the official if they so wish.
The ballot will have two boxes marked "Yes" approving the recall and "No" disapproving the recall. there will also be a list of candidates for whom those that voted for the recall may vote for to replace the official. In this sense the recall election is held simultainiously with the election of the new official.
If a majority of voters vote "no" on the recall, the official whom the recall was filed against will remain in their position. If there is a majority "Yes" votes then the new official will be the candidate on the list with the most votes.

With no Amendment 64 on the ballot dragging out a higher than normal amount of left-leaning voters and an equally high amount of voters that only turned out because of the presidential election no longer showing up, a recall election has a very, very real chance of succeeding. I wonder if these clowns pondered these facts when they came up with this garbage.

Even the threat of recall might be enough for these jackwagons to get the message. Also, it would not hurt to remind them that the next election cycle is not that far away, and gun control legislation, aside from repealing assinine measures already on the books- background checks which are an illegal invasion of privacy for example- will be political suicide for them and if they vote for any additional legislation the pro-gun constituency will make sure that no one ever forgets who voted for what.
Recall election/petetion is a real step. Key members of the state assembly and Hickinstooge should be recalled. But we need to learn from the pot-heads. Why not add a ballot initatives to (1) eliminate and protect against 2nd amendment infringements, (2) protect citizens 2nd amendment rights during states of emergency, and (3) Nullify federal firearms regulation which infringes on the 2nd amaendment. The pot-heads got legal dope. There are probably more of us than there are of them.

The recall thing could work, provided it comes across as legitimate and warranted. Just go for that one guy. Don't play shotgun because we're using birdshot and nothing will happen. We need to be professional and credible so making a big list everyone and shouting with torches and pitchforks will get us nowhere. Just go for the one guy. The rest will get the message, even if it just comes close.

My response from Bennet:
Dear Shawn:
Thank you for contacting me regarding some of the different gun proposals that have been introduced during the 113th Congress, including S.33 introduced by Senator Frank Lautenberg, S.150 introduced by Senator Dianne Feinstein, and the proposal put forth by President Obama. I appreciate hearing from you.
The numerous tragedies that our nation has had to face over the past year have been staggering. My own family, like all Americans, has been repeatedly shocked and deeply saddened by the violence we have witnessed, and my heart continues to be with the victims and their families. As Coloradans, we know how this type of tragedy can shake a community to its core and in the aftermath of these abhorrent acts our priority should be on supporting the survivors and families, and healing our communities.
We must have a real discussion in this country about finding ways to stop these senseless shootings. I believe a combination of improved access to mental health services, restrictions on certain weapons intended for warfare, and elimination of the gun show loophole are sensible steps that can protect our communities and particularly, our children. In Colorado, we support the right to bear arms and the ability of people to recreate, hunt, and protect their homes, and we want to keep the wrong weapons out the hands of the wrong people. I believe we can have a civil discussion that addresses these issues and as the recommendations by the President's task force are considered in Congress, we will ensure that Colorado's voices are heard.
In addition to the bills referenced above, there are a number of different legislative proposals on gun policy currently before Congress. I am evaluating all of the different bills, and I will keep your thoughts in mind as we work on this issue in the Senate. Let us all continue to keep the communities affected by these tragic acts in our thoughts and prayers.
I value the input of fellow Coloradans in considering the wide variety of important issues and legislative initiatives that come before the Senate. I hope you will continue to inform me of your thoughts and concerns.
For more information about my priorities as a U.S. Senator, I invite you to visit my website athttp://bennet.senate.gov/. Again, thank you for contacting me.
Sincerely,

This is nothing more than the criminalizing of political opposition. This is really nothing new as our history books used to be full of examples of these very acts.
I am willing to have the recall petitions at my tables at the next gun show, should get a lot of signatures there! Or, if ballot inititive is the way to go I am willing to have the signature sheets there too.
actual bill numbers and text are available for 4 of em

I thought this was useful info from Morse's FB page
"I would like to remind the Senator of just how close his election was in 2010: Less than 1% margin, with a 3rd party candidate taking 4.5% of the vote.
It would take only 3363 petition signatures in his district to start recall proceedings should you continue to propose violating the rights of law-abiding citizens of Colorado."
That would number of signature should be very attainable in a short amount of time.

what the hell does paying for a background check have to do with this clause?
SECTION 2. Safety clause.

BECAUSE everyone who owns a gun is running around with their heads cut off. TRYING to buy guns, ammo & components. Peace of Mind, health (i know i'm having heart issues) Safety, It's for the EYEdITS camping over night at SW concerned about them getting frostbite or something.
Ironic, you have maybe 1/2- a dozen folks in a parking lot overnight and not One criminal act committed.
My letter:
I have read Bills 1224, 1226, 1228, 1229. I am against these draconian measures. These bills would do nothing to prevent crime or lunatics from endangering others. These are not about gun control; these bills are about controlling people. Anyone supporting these measures is supporting the agenda of the Democratic Party Leadership and not the interests of the law abiding citizens of Colorado.
I find it particularly disgusting that Bill 1224 targets at least one Colorado Company (Magpul) and hundreds of Colorado jobs. Not to mention the personal property and protection rights guarantied by the United States Constitution.
Bill 1226 strips Colorado Citizens of the right to protect themselves on State owned college campuses. I am currently attending UCD on the GI Bill. I served 22 years in the USMC and I am a Disabled Vet. I get a average of 3 campus alert messages a week for robberies, sexual assaults and other crimes. The US Supreme Court ruled in "Heller" "the State (a governing body) that prohibits citizens from protecting themselves is legally and criminally liable for injury or loss of life." Armed security is not a defense.
It's nice to know that after 22 years of service to my country, I retired to find the rights I fought for are stripped from me.
How will you vote?

Unfortunately, that POS Morse's district extends from Manitou Springs SE through Old Colorado City and then eastward to Powers Blvd. Still ... 4000 signatures ought to be doable if the petition is framed right. The grievance should clearly stated and restricted to his support for these unconscionable, immoral and unconstitutional propositions.

I get those alerts as well. I'll be damned if I'm going to leave my gun at home while I have to walk a mile to my car twice a week at night on that campus.

Taking CO303's lead I came into work early to draft an email.
At first I was thinking of hitting all 4 of the bills but now thinking I'll shoot one email per bill with why I oppose each one.
Here is my first one-thoughts before I push it?
As a USAF Academy Graduate, veteran of OIF, OEF, OEF-P, former El Paso County Sheriff’s deputy, responsible and contributing member of my city, state, and country I would like to voice my opposition to Colorado Bills: 1224, 1226, 1228 and 1229. None of the proposed laws would do anything to curb mass murder events or common street crime and are a burden to law abiding citizens such as myself.
My wife served in the Air National Guard and was a POST certified law enforcement officer for the State of Colorado at the UCCS campus. She has left the law enforcement profession to pursue her passion in the field of physical therapy. As a concealed weapons permit holder she has legally carried her weapon daily while attending to her studies in physical therapy at a State campus without notice or incident. Bill 1226 strips Colorado Citizens of the right to protect themselves while on State owned college. As a former peace officer for a State campus she is well aware of the limitations that armed security and law enforcement has in protecting every student on a large campus. Please do not strip my wife’s right to choose. Do not take away the liberty to choose the way she decides to best protect herself from assault, rape or murder.

I don't think the Democ-rat bastards in Denver give one rat's arse about your service in the AF or in our wars but your second paragraph should hit them where it hurts -- they're disarming WOMEN. I like how you ended with what Holbert told us were the four most important words.

Tell a lie long enough...
An estimated 40% of all gun purchases occur without a background check, allowing hundreds of thousands of guns to get into the hands of criminals each year. Current law in Colorado only requires background checks on gun purchases that take place at gun stores and gun shows, but not for private sales or sales on the web. A recent undercover investigation showed that 62 percent of private sellers on the Internet were willing to sell to someone who said he couldn’t pass a background check.

I don't think most Democ-rat bastards in Denver will care on rat's arse about my argument either, or my service, to tell you the truth. I'm more concerned with the Dems that are sitting on the fence as they are worried about keeping their jobs. I would like to know who those are.
