[yes, another post, but here's everything you need to know]

All 4 gun bills passed the House today. Next is the Senate, and our last stand b/c Hickenlooper already announced his support for all the gun bills except HB13-1226 (or has he? (http://www.ar-15.co/threads/90559-MMmm-I-smell-waffles-Hickenlooper-feeling-the-pressure)).

Dems hold a 20-15 majority in the Senate, so 3 Dems have to defect to kill any bill on the floor. But the best way to kill a bill is in committee. Here are the bills and their most likely paths through committee before any bill can reach the Senate floor:

HB13-1229: requiring background checks for all gun transactions; Judiciary & Appropriations

HB13-1226: banning concealed weapons on campuses; Education & Appropriations

HB13-1228: instituting a fee for gun buyers to cover the cost of the CBI to perform background checks; Finance & Appropriations

The ones I spoe with are indignant and they are not even actively calling or writing senators and representatives. Not a single person at the capitol that I asked who they voted for said anything other than R down the line. We have too many who do not understand because we have largely been too complacent.

I've been sending non-stop postcards to the senate democrats for the past week. I have 5 different postcards made up that all same similar things. FWIW: If you are sending snail mail, make sure you put a return address of some sort or they will not accept it (so I've been told).

pretty sure he knows that. He has already said he'll sign it. He has already flopped once when it was politically convenient (to get D elected last fall), he wont flip back.

Subject: NO Gun Control - IT IS UP TO YOU To Protect our 2nd Amendment Rights

Colorado Senators,

Now it is up to you to defend our 2nd Amendment rights. I know many of you have already told me you intend to do just that – I know you have taken the same oath I did as a military veteran – To Defense the Constitution of the United States against all enemies, foreign and domestic. We know what the 2nd Amendment says about our rights not being infringed. Unfortunately your counterparts in the House do not understand how the bills proposed infringe upon those rights.

HOW WILL YOU VOTE?

HB13-1229: Requiring background checks for all gun transactions – let’s consider the fact that in each case in recent history, those whose criminal actions have led to this current frenzy to remove our rights ALL purchased their firearms legally through the background check system with the exception of the monster Adam Lanza. Adam’s mother unfortunately lost her life because her son decided to kill her for her weapons, which she purchased legally. I am trying hard to understand HOW this bill would do anything to prevent another Adam Lanza, James Holmes, or a Jared Laughner from doing what those sick people did to others. Please tell me HOW…. I’ve not heard this from anyone. What this law does is infringe upon my right to sell a firearm privately to someone I know, who likely has a Colorado Conceal Carry Permit, or who has already passed background checks in their past. This is a direct attack against our 2nd Amendment rights (I can’t give a firearm I own to my son???) – and for WHAT reason? Please someone tell me. How is this not infringing upon our 2nd Amendment right?

HB13-1226: banning concealed weapons on campuses – college age students are old enough to vote, buy booze, buy pot (I’m sure that’ll be coming soon), and to buy guns, but they are not allowed to carry them on campus? What is the rationale? Has anyone look at the FBI data around violent gun use at college campuses? What did that say? The massacre at Virginia Tech was conducted in a GUN FREE ZONE. The evil murderer Cho, an individual adjudicated as mentally unsound, was allowed to purchase handguns without detection by the National Instant Criminal Background Check System (NICS). See HB13-1229 – the irony of this is sickening. Cho legally bought the firearms that he used to murder innocent people with in a gun free zone. Is your intent to have this happen MORE OFTEN in our state? How is this not infringing upon our 2nd Amendment right?

HB13-1228: instituting a fee for gun buyers to cover the cost of the CBI to perform background checks – this is not gun safety, this is a gun tax. We pay Federal and state taxes today, and yet this bill says we need to pay tax for the mandatory background check. See HB13-1229 – the House wants to make this background check mandatory for all transactions, and they want to tax us for it as well? First off, how does this make anyone safe? Second, this is self-serving – all dealer transactions require a background check by law (to include gunshows), and yet the House wants to make all sales require a background check, and then make gun owners pay a tax for that mandatory requirement. How is this not infringing upon our 2nd Amendment right?

HB13-1224: limiting magazines to 15 rounds – the absolute worst of the lot. Someone has to explain how limiting anything from whatever to 15-rounds makes anyone safe. Where is the research to prove this to be true? The truth is that states with 10-round magazine bans DO NOT see a decrease in crime. Those states with the most draconian laws have a higher rate of violent crime nationally. Worse than this, the bill infringes upon our right to defend ourselves effectively by telling us (law abiding gun owners) that we can only have 15 rounds. Does ANYONE believe that criminals will follow this law? Do you really believe James Holmes, Adam Lanza, or Jared Laughner would follow these laws? The answer is NO – you know it, and we know it. Plus, a Colorado Business that is profitable, and produced outstanding equipment (Magpul) will be forced to move because of this legislation. Even if they are provided an amendment, they will need to move to avoid being boycotted for hypocrisy. HOW does limiting our rights to more than 15-round KEEP ANYONE SAFE? Please explain this to me – I’m just a simple American Military Veteran and a director of church security for a large church in the Denver Metro area. I must be too simple to see the obvious reasons – but I’ve talked to a great many angry Coloradans who also fail to see how this will keep anyone safer, except for the criminals. How is this bill not infringing upon our 2nd Amendment right?

Take away jobs, remove our ability to have the same capacity magazines as criminals, tax us for mandatory background checks, ban conceal carry for mature adults on campus to make those killing zones, and require background checks for all private transactions. Sounds like the House bills do nothing but infringe on our 2nd Amendment rights.

HOW DO THESE BILLS KEEP US SAFER? What has the House proposed that would keep us safe – nothing… There is NOTHING about mental illness – nothing about enforcing our current laws, nothing about removing gun free zones for legal conceal carry holders, nothing for keeping us safer. The opposite is true – restrict, regulate, tax, and infringe…

Remember this – Colorado Gun Owners span both parties and make up quite a few “independent voters”. If these bills pass, you can bet that Colorado Gun Owners across all parties, and backgrounds will all make the necessary changes in 2014 and 2016 to ensure that our 2nd Amendment Rights are NEVER AGAIN infringed upon.

Magazine Limits –
Banning the sale and transferof magazines that hold over 15 rounds will have no impact on the thousands ofColorado Citizens that already own millions of high capacity magazines. Additionally, since there are generally no restrictions on selling these highcapacity magazines in other states, added to the fact that you will lose the mainmanufacturer of these magazines in Colorado, will make this lawunenforceable. This is because no manufacturer will date their magazines,as required of Colorado magazine manufacturers after the law is enacted. The law will be unenforceable. Unless someone gets caught crossing the borderwith these banned magazines, they will not get caught. Also, these laws will put alot of locally owned and operated Colorado gun shops out of business. 1228: - Background check fees: "Punishment tax" on people who have done nothing wrong; "killers" affect public health, not "gun owners".

1229: - Universal background checks: "Almost impossible to enforce, undue requirements on FFLs, makes some forms of family gifting of heirlooms impossible, will overload the InstaCheck system".

SPECIFIC TO 1224: (1224 - mag limit - has been my 'focus' so here are some of what I've used in previous letters)

These are what appear to have the most mileage with (D) legislators.



The law won’t do what people think it will; it’ll DEFINITELY penalize law abiding folks but the idea that it’ll even save one life is only a hunch, and unlikely.
Correlation isn’t causation; Fields stated that “all of the mass killings have one thing in common – “high cap mags”. These are considered ‘standard cap mags’, and they come with every AR-15, the most popular rifle in the US for the last 15 years. So it is more likely that ‘mass killings have them as a thread simply because they are popular.’ Also "Less bullets = less crime" is a vast oversimplification.
More of these 30 round mags exist than 10 and 20 round mags combined. They are sold with every popular rifle. 10s and 20s are rare.
MagPul leaving in this economy will DEFINITELY devastate families. The social benefit of the mag ban is, again, nothing more than theoretical, it’ll certainly do harm, it’ll maybe (but unlikely) do good.
“Banning” and criminalizing non-criminals isn’t OK; there are a lot of other possible ideas besides an outright criminalization or illegalization of them.
Many guns in normal sporting use don’t even have 15 round mags; even ones that use 16 as a standard (Springfield XDm) would never be able to be repaired if broken, causing loss to a lot of folks without doing wrong.
Odds stacked against, for example, rural families far away from 911, since home invaders and violent criminals will not abide by the law. 'Families will be outgunned by criminals' who will have illegal capacity magazines, where citizens will not.
And lastly, underline: it won’t be effective, as crazies/murderers/criminals aren’t going to care at all about the legalities of bringing these magazines into state. Only law abiding folks will care; those who wish to commit mass killings will still do so.



Remember, use your own words, speak from the heart but do not get irate.

Agreed. Looking at the committee members, only Andy Kerr is a question mark and can affect the college campus bill and background check fee bill. The other two bills should sail through committee along partisan lines.

Colorado Senators,

Now it is up to you to defend our 2nd Amendment rights. I know many of you have already told me you intend to do just that – I know you have taken the same oath I did as a military veteran – To Defense the Constitution of the United States against all enemies, foreign and domestic. We know what the 2nd Amendment says about our rights not being infringed. Unfortunately your counterparts in the House do not understand how the bills proposed infringe upon those rights.

HOW WILL YOU VOTE?

HB13-1229: Requiring background checks for all gun transactions – let’s consider the fact that in each case in recent history, those whose criminal actions have led to this current frenzy to remove our rights ALL purchased their firearms legally through the background check system with the exception of the monster Adam Lanza. Adam’s mother unfortunately lost her life because her son decided to kill her for her weapons, which she purchased legally. I am trying hard to understand HOW this bill would do anything to prevent another Adam Lanza, James Holmes, or a Jared Laughner from doing what those sick people did to others. Please tell me HOW…. I’ve not heard this from anyone. What this law does is infringe upon my right to sell a firearm privately to someone I know, who likely has a Colorado Conceal Carry Permit, or who has already passed background checks in their past. This is a direct attack against our 2nd Amendment rights (I can’t give a firearm I own to my son???) – and for WHAT reason? Please someone tell me. How is this not infringing upon our 2nd Amendment right?

HB13-1226: banning concealed weapons on campuses – college age students are old enough to vote, buy booze, buy pot (I’m sure that’ll be coming soon), and to buy guns, but they are not allowed to carry them on campus? What is the rationale? Has anyone look at the FBI data around violent gun use at college campuses? What did that say? The massacre at Virginia Tech was conducted in a GUN FREE ZONE. The evil murderer Cho, an individual adjudicated as mentally unsound, was allowed to purchase handguns without detection by the National Instant Criminal Background Check System (NICS). See HB13-1229 – the irony of this is sickening. Cho legally bought the firearms that he used to murder innocent people with in a gun free zone. Is your intent to have this happen MORE OFTEN in our state? How is this not infringing upon our 2nd Amendment right?

HB13-1228: instituting a fee for gun buyers to cover the cost of the CBI to perform background checks – this is not gun safety, this is a gun tax. We pay Federal and state taxes today, and yet this bill says we need to pay tax for the mandatory background check. See HB13-1229 – the House wants to make this background check mandatory for all transactions, and they want to tax us for it as well? First off, how does this make anyone safe? Second, this is self-serving – all dealer transactions require a background check by law (to include gunshows), and yet the House wants to make all sales require a background check, and then make gun owners pay a tax for that mandatory requirement. How is this not infringing upon our 2nd Amendment right?

HB13-1224: limiting magazines to 15 rounds – the absolute worst of the lot. Someone has to explain how limiting anything from whatever to 15-rounds makes anyone safe. Where is the research to prove this to be true? The truth is that states with 10-round magazine bans DO NOT see a decrease in crime. Those states with the most draconian laws have a higher rate of violent crime nationally. Worse than this, the bill infringes upon our right to defend ourselves effectively by telling us (law abiding gun owners) that we can only have 15 rounds. Does ANYONE believe that criminals will follow this law? Do you really believe James Holmes, Adam Lanza, or Jared Laughner would follow these laws? The answer is NO – you know it, and we know it. Plus, a Colorado Business that is profitable, and produced outstanding equipment (Magpul) will be forced to move because of this legislation. Even if they are provided an amendment, they will need to move to avoid being boycotted for hypocrisy. HOW does limiting our rights to more than 15-round KEEP ANYONE SAFE? Please explain this to me – I’m just a simple American Military Veteran and a director of church security for a large church in the Denver Metro area. I must be too simple to see the obvious reasons – but I’ve talked to a great many angry Coloradans who also fail to see how this will keep anyone safer, except for the criminals. How is this bill not infringing upon our 2nd Amendment right?

Take away jobs, remove our ability to have the same capacity magazines as criminals, tax us for mandatory background checks, ban conceal carry for mature adults on campus to make those killing zones, and require background checks for all private transactions. Sounds like the House bills do nothing but infringe on our 2nd Amendment rights.

Fax needs to go to one individual at a time. If you're blasting e-mails, which are relatively useless with most reps, use BCC so only a single recipient shows on their end.


Make the subject line "VOTE NO on XXXX"

Make a brief statement of your opposition.

If you wish, make a brief statement of how the bill will negatively affect you.



Don't write long paragraphs.
Use bullets if needed.
Make it EASY to read.
Highlight relevant buzzwords or short statements of fact.


Add your name and location.

If you really thought it would not pass the house, you have not been paying attention. The Senate is a tougher sell.

Saying we "lost" is what they want. It is like when the stock market goes down and you say you lost 5%. No, you did not, because you did not take the money out yet. We have not lost unless it gets signed into law, and even then there are paths. Problem is too many people tossing rocks and not enough people actually involved. I am not bashing ANY COAR15 members. You all have been great. But, how many people are gun owners who have still done NOTHING? The answer is more than 99%!

I am very worried about the negative impacts of these bills to individual liberty, safety and jobs in Colorado. I cannot believe that we are even this close to passing them.
I want you to remember who has been pushing these bills that infringe upon our Second Amendment. No Republican will vote for any of these bills. These bills are supported only by Democrats; even the few Democrats who voted against them in the House voted to enable Democrat Leadership to ram these bills through.
Never forget that. Make sure that you hold them accountable in the next election cycle.

I received replies from Republicans from my emails today. All total, from sending emails and faxes everyday, I think I've heard from 5 democrats total. I think sending them to everyone (dems and reps) helps to solidify the 'no' position and may even give them a confidence boost. It doesn't hurt and if they go into it knowing their constituents are for it then their arguments will be even stronger. So IMO it can only help.

At this point, the 4 bills are assigned to committees and they are still working on the Senate bills. So it will likeley be 2 to 3 weeks before they schedule committee hearings. There are more bills written and some in writing realted to this issue, so there is some uncertainty what effect that may have. The Senators I spoke with today have told me they are getting slammed with emails, call and letters. A few of the Ds have engaged in meaningful dialog with people I know and myself. They have been open and repsectful on the phone, more so than in writing...take that for what it is worth. The Ds I have spoken with have expressed some concern over one or two bills, but plan to vote in favor of one or more.

I think this issue will be just like the gay marriage and marijuana iniatives. They failed over and over again, but the left is relentless. They don't give up. We need to be more ruthless and relentless like they are. Let's first focus on the current battle though, and worry about future ones as soon as this one is won or lost. Literally, I think if we somehow win this battle, we should immediately go on the offense. First things first though.

Bills can still be introduced. There are more waiting and some still being drafted. These bills are likley to make it out of the senate committees. So it will be a full vote.

Here is my latest email, which is longer than most I sent. I've borrowed bits and pieces from other folks and added some of my own content in.

I hope that you will vote NO and voice your opposition to all 4 of the Firearms proposals that have passed the Colorado House today. These misguided,“fast patch” responses to some extraordinary firearms events in the past yearand will do nothing to protect the general public. In fact , theultraviolent cultures that have evolved in cities like Chicago and Washington D.C. have become worse after the enactment of similar types of laws. Itis my opinion that the State of Colorado will only increase the likelihood ofinnocent people being hurt by enacting these laws.

Magazine Limits –
Banning the sale and transferof magazines that hold over 15 rounds will have no impact on the thousands ofColorado Citizens that already own millions of high capacity magazines. Additionally, since there are generally no restrictions on selling these highcapacity magazines in other states, added to the fact that you will lose the mainmanufacturer of these magazines in Colorado, will make this lawunenforceable. This is because no manufacturer will date their magazines,as required of Colorado magazine manufacturers after the law is enacted. The law will be unenforceable. Unless someone gets caught crossing the borderwith these banned magazines, they will not get caught. Also,don’t ban the standard magazine for whole classes of weapons that are used andcarried, legally and safely, buy thousands of Coloradans. Charging for BackgroundChecks –
First, the state should payfor this required step in acquiring a firearm. This is a 2ndamendment issue and one should not be charged by the government to exercise aright guarantee by the 2nd amendment of the Bill of Rights. Second, banning private sales without background checks will lead to thecreation of a new black market in firearms within the borders of Colorado.

The most frightening aspectof enacting these three laws, is that they will drive up the prices of new, andvalue of existing, guns and magazines in Colorado. The loss of 600 jobs as Magpul and other companies leave Colorado.

The loss of tourism revenue and further impact to the general fund as gun owning tourists and out of state hunters boycott Colorado because of the these bills.

Lack of support from Colorado sherriffs in enforcing any new laws.

I first moved to Colorado because it was the shining example of personal freedoms working successfully in our country. Sad to see they are slowly trying to change it into California. You want to get stoned peacefully? I don't care. You want to be allowed marry your gay partner? I'm okay with that too. Hell if you're a gay gun owner that's even better! I just hope our pleas don't fall on deaf ears. As a minority gun owner I hope these politicians at least consider that not every gun owner falls under the stereotype portrayed in the media. I wouldn't give to much weight regarding what is said in an e-mail response. Those are usually written by aides or interns but are directed by the elected official somewhat. I would know.

IMO though, she is probably the only chance at #3. She represents a competitive district and is up for reelection in the next cycle. I would like to know what she's saying in person or by phone.

How is it that you so easily cannot see the fact that criminals do not obey laws, by their very nature, or is it that you have so much contempt for law abiding citizens that you willingly ignore facts and logic?

However I must disagree with you. The bills that are being heard in the Senate Committees do infringe on CO residents rights to bear arms. Limiting magazines to 15 rounds will do nothing to prevent the recent tragedies and only harm law abiding citizens.
Requiring a 4473 for every firearm transaction limits law abiding citizens to their access of firearms and is unenforceable. Criminals who cannot purchase firearms legally are not going to comply and will continue to purchase firearms from the black market.
Requiring a purchaser of a firearm to pay a fee for a 4473 is a TAX. And I'm here to tell you, if I have to pay a tax for a 4473, then I had better not have to wait 7 days for the background check to go through.
And lastly, contrary to what your colleagues in the House might say or think of CCW holders, we are some of the most responsible gun owners in the state. We have taken a class and gone through training, we have paid money for our license, and we have been through an FBI background check. When someone has willingly put themselves through that type of scrutiny and put that responsibility on themselves that person takes it seriously and are not gun toting "cowboys" as we have been portrayed. Restricting people from carrying their concealed weapon on a college campus will only make them easy targets for criminals.

I would like to ask you a few questions. Do you really think criminals care what laws you pass? Do you really think a bill limiting the amount of cartridges that can be stored in a magazine will stop the next James Holmes from obtaining standard capacity magazines? It took police and bomb squad members up to three days just to gain access to his apartment. Do you really think these new laws will stop someone with that kind of determination from harming people? They're criminals for a reason and will continue to break the laws you pass.
All these laws will do is put further unneeded restrictions on good, honest, hardworking, law abiding citizens that vote. I ask you to reconsider your position and put time and energy where it's really needed and that is in a better mental health system and enforcing the existing gun laws that are on the books. Please do not turn this state into a California, New York, or New Jersey. That's not why I moved here.

We will be watching and remembering how you vote on this. If you choose to limit mine and other law abiding citizens freedoms and push jobs out of state, then we will have no choice but to campaign against you in the next election.

Regardless of how these guys vote, these bills have been very stressful. Personally I have been stressed and have got pretty ill from the constant stress. Let's say this junk does not pass , I am not going rest on my laurels hoping this is over. I still say there should be a movement tp recall the clowns behind this and a tremendous effort on the next election to rid ourselves of these people. I still believe what is going on is the demoncrats are trying to bitch slap us for perceived injustices or just show their power. The know the 2nd is one of our most passionate belief, so they to f with it to basically throw mudd into our faces.

Agreed. I think this is a little bit of payback for letting the civil union bill die in committee last year. I do think there should be a push for a State Constitutional amendment of some sort to prevent restrictions on firearms.

Neither of them hesitated in their answer that, yes, they would be happy to lock me up for a year just for having a magazine.

Note that I'm a law abiding taxpayer with a job, mortgage, and a kid, and neither of those two had a problem with destroying my life and the lives of my family simply for having a metal box with a spring in it.

Simply put, these people are completely irrational and the time to try to persuade them with reason has long since passed.

Dear Senator,

I will politely disagree with your stance on the measures. Limiting magazine capacity will only punish those who obey the rules vs. a criminal that will disregard the law anyway if they are intent on harming others. As for carrying on college campuses, if there has been no incident of misuse or abuse of carrying on campus why change a law that isn't broken? Are women not allowed to choose their own method of defense against an attacker? I am also curious to know how does one justify legalizing a federally banned substance such as cannabis, while proposing to limit Second Amendment rights on law abiding citizens? The wonderful thing that made Colorado a special place for personal liberties before all of these bills were brought forth, was that people were given more latitude to enjoy their personal freedoms responsibly without interference from others. Even with two highly publicized criminal incidents, they spanned more than 10 years apart and are not the norm in a state where crime is much lower than in other places in the country. Compare that with places like Chicago, and Los Angeles which have high violent crime rates that have very strict gun control laws. Are those people being kept safe? I would like to believe that Colorado is still the place where the individual can enjoy freedoms other states can only dream of, let's not punish those who live justly for the actions of a small number of violent thugs.

Checking on Mr.Morse he is termed limited and will be out in 2014. However he has bought an Apartment in another area so he can run for office again. He has big goals so be aware he will do what he can to stay in the political picture.

Comparing the Democrat and Republican participants turned up differences in two brain regions: the right amygdala and the left posterior insula. Republicans showed more activity than Democrats in the right amygdala when making a risky decision. This brain region is important for processing fear, risk and reward.
Meanwhile, Democrats showed more activity in the left posterior insula, a portion of the brain responsible for processing emotions, particularly visceral emotional cues from the body. The particular region of the insula that showed the heightened activity has also been linked with "theory of mind (http://www.livescience.com/26691-babies-understand-other-peoples-beliefs.html)," or the ability to understand what others might be thinking.
While their brain activity differed, the two groups' behaviors were identical, the study found.
Schreiber and his colleagues can't say whether the functional brain differences nudge people toward a particular ideology or not. The brain changes based on how it is used, so it is possible that acting in a partisan way prompts the differences.
The functional differences did mesh well with political beliefs (http://www.livescience.com/24620-postelection-can-we-all-get-along.html), however. The researchers were able to predict a person's political party by looking at their brain function 82.9 percent of the time. In comparison, knowing the structure of these regions predicts party correctly 71 percent of the time, and knowing someone's parents' political affiliation can tell you theirs 69.5 percent of the time, the researchers wrote.

I'm from VA but I used to work for a company that had interested in Longmont/Boulder and Denver. I was alerted on NRA-ILA about some legislation that is advancing in Colorado and wanted to help in a small way.

I've emailed all dems and republicans in your senate and posted on various facebook accounts.

Dear Senator,
I am writing to request that you vote NO against the following Gun Bills:

HB13-1229: requiring background checks for all gun transactions; Judiciary & Appropriations

HB13-1226: banning concealed weapons on campuses; Education & Appropriations

HB13-1228: instituting a fee for gun buyers to cover the cost of the CBI to perform background checks; Finance & Appropriations

HB13-1224: limiting magazines to 15 rounds; Judiciary

None of these bills will help to reduce violent crime and they will only impact law abiding citizens.

Make no mistake that there are many people watching these bills in the Colorado legislature. I want you to do the right thing and vote against these Bills.
I will be supporting all pro-2nd Amendment candidates in the upcoming election. I will also be ACTIVELY campaigning AGAINST any legislator that is voting for or submitting ridiculous anti-gun legislation that restricts my 2nd Amendment Rights that cannot be directly linked to a positive impact on violent crime. Believe it. I’m not writing this email at 4am simply because I can’t sleep.

These campaigning actions include my money, my time and my voice via my friends, acquaintances, social media and my physical presence to oppose you at your campaign events.
