And he came up with an interesting point. It seems that the Department of Labor and another .gov entity did some investigation on pre-employment back ground checks. It seems they have discovered that they are discriminatory and possibly unlawful. Although he did not divulge the exact numbers he stated that the majority of people declined employment because of failing a background check were minorities.

Background checks were racist.
Now I am not sure but I do not believe employment is a right however the RTKBA is.

Racist and discriminatory to have to undergo a BGC to practice your RTKBA?

If i have to pass a drug screening, everyone needs to pass a BG check.

EEOC comes out with a bunch of goofy shit on a regular basis. The problem for them is, "Disparate impact" as a form of employment discrimination, in the absence of discriminatory intent, is a bitch to prove. Especially since so many of the things with a supposed "disparate impact" are still legitimate legal reasons to discriminate, or "Bona-Fide Occupational Qualifications" in the legalese: not hiring bus drivers with DUI convictions, for instance. That may or may not have a disparate impact on minorities (I have no idea) but it's a pretty reasonable reason to not hire someone for a driving job. Or crappy credit with gambling debts for someone who handles cash. Or someone with no arms to be a bouncer at a strip club.
