Stupid ar pistol legal question....

I just built an ar pistol in 556 with a 7.5 inch barrel. Now I know if you have a pistol upper you have to have a pistol lower if you have rifle lowers or its a constructive possession issue. Now that I have multiple complete ar rifles and one ar pistol, can I have multiple pistol length uppers for the one pistol lower?


Stupid question, but covering my bases, as I want a 300blk shorty upper to switch back and forth on the one pistol lower.

1 pistol lower, and 1 pistol upper = OK
1 pistol lower and multiple pistol uppers = OK
0 pistol lowers and any number of pistol uppers = bad mojo

Same goes with SBRs:
1 SBR lower, and 1 or many short uppers = OK
(as long as your form 1 barrel length covers the smallest barrel length on hand)

I'm going to try out the sig brace for now, but I have had the nfa bug nipping a bit in the desire to add an ar15 sbr to the AK sbr in my trust. So that helps with my possible future stupid questions. [emoji2]

When you price a Sig brace, buffer tube, spring & buffer new. For a few dollars more i'd Form 1 everything.

There's no waiting period on a brace though.

How do you figure? The brace is only about $40 more than something like a B5 sopmod or other similiar stocks. You'd still have to buy all the other parts so that is a wash. Then we have to tack on the $200 for a stamp and whatever you paid to setup a trust if you have an Anti-2A Commie for a CLEO in your county. Then there's the cost of 922r compliance if you are SBRing a foreign made weapon which can be significant.

The brace frees you from all that. No more NFA entanglements. No more Form 1s. No more trusts/CLEO signoff. No more 922r compliance requirements. No more having to ask Federal permission to take it across state lines, etc. You can even conceal carry it in back pack if you like and not run afoul of hunting regs. It may be ugly but it's 100% functional and gives us a way around the unconstitutional NFA and its arbitrary restrictions on something as stupid as barrel length. Given a choice I'd rather give my money to Sig or Century Arms instead of feeding the ATF.

All solid points. I just got my sig brace. FANTASTIC. Its about as long as a regular CAR stock out one click. Close enough for me.

Until the ATF re-rules on the brace after seeing all the youtube videos of people firing AR pistols with the brace like a rifle. They may require a redesign to make it very uncomfortable to shoulder fire. Something like requiring the buffer tube to extend at least X inches past the brace. Not saying it will happen, but you never know.

What's a past example of the ATF reruling on something?

Essentially nothing. If the lower was transferred from the FFL as "other" like it should be it can be built as a rifle or a pistol. Once assembled as a rifle though, it's always considered a rifle and can't be reconfigured into a pistol.

thanks--ok, next stupid question--is there a difference in a "pistol" upper? or do you just buy the barrel length you want, chuck it on the lower, and as long as you don't have a stock, you've got the AR pistol?

The only physical differences between rifle and sbr is the barrel and gas tube length

The only differences between rifle/sbr and pistol is buffer tube, stock, barrel, and gas tube length.

ANYTHING less than a 16" barrel is considered a NFA / SBR or Pistol Upper. DEPENDING what your plans are. I have X SBR's and X pistol lowers (already set up as) How many uppers and what barrel length i have is irrelevant. As anyone, outside a Vague legal interpretation would agree.

AS for "chucking it on the lower" ONLY if you purchased the lower as OTHER or PISTOL.

Form 1 it so you don't have to have that ridiculously hideous brace on the end.

Ok, next question--carbine length buffer or pistol buffer?

You need a pistol buffer if you're building a pistol.

The reason i asked is that palmetto state armory sells this complete pistol lower with a carbine length buffer

Their pistol LPKs come with a carbine buffer.

That depends on what buffer tube you go with, I did a 9mm build , running a H6 buffer with a rifle (A2) sized recoil spring. There's shorter buffer, spring & pistol tube set ups.

Sorry, I was thinking of the tube, and not the actual buffer.
