    Essentially nothing. If the lower was transferred from the FFL as "other" like it should be it can be built as a rifle or a pistol. Once assembled as a rifle though, it's always considered a rifle and can't be reconfigured into a pistol.

    thanks--ok, next stupid question--is there a difference in a "pistol" upper? or do you just buy the barrel length you want, chuck it on the lower, and as long as you don't have a stock, you've got the AR pistol?

    The only physical differences between rifle and sbr is the barrel and gas tube length

    The only differences between rifle/sbr and pistol is buffer tube, stock, barrel, and gas tube length.

    The rest is just bureaucratic bullshit brought to you by your friendly government alphabet agencies.

    ANYTHING less than a 16" barrel is considered a NFA / SBR or Pistol Upper. DEPENDING what your plans are. I have X SBR's and X pistol lowers (already set up as) How many uppers and what barrel length i have is irrelevant. As anyone, outside a Vague legal interpretation would agree.

    AS for "chucking it on the lower" ONLY if you purchased the lower as OTHER or PISTOL.
